1.The development hereby permitted must be begun not later than the expiration of two years from the date of the final approval of the reserved matters Reason: The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004, and to secure timely and swift delivery of housing in light of the Borough Council's housing land supply situation at the time of the decision being made to grant planning permission.
2.The development shall be carried out in accordance with the following revised documents and drawings listed below: 373-011 Rev C - Site Plan and Elevation to Acle New Road Entrance, received by the Local Planning Authority on 9 September 2022; 373-012 Rev A - Proposed Elevations/Streetscene, received on 9 September 2022; 373-014 Rev A - Floor Plans, received on 12 December 2023; 2820-24 Revised Landscape Plan, received on 20 February 2024. Reason: For the avoidance of doubt.
3.Unless otherwise agreed in writing by the Local Planning Authority all dwellings shall be constructed in accordance with the approved plans set out in condition 2 above and shall also include the following: · Compliance with Building Regulations Part M Category 4(2) - accessible and adaptable dwellings, where practicable and feasible; · Features and fittings which limit water consumption in dwellings to 110 litres per person per day; and · Provision of electric vehicle charging points. · Boundary Treatments. . Details of refuse storage and locations. . On site car and cycle parking and turning areas. . Tree Protection measures during construction. Where the development is unable to achieve the standards and expectations described above, no development shall commence until full details of alternative proposals and mitigation measures to address the requirements have first been submitted to and approved in writing by the Local Planning Authority, and thereafter the development shall be undertaken in accordance with those approved details. Reason: To ensure the proper development of the site in making provision for the demand for electric vehicle charging within the lifetime of the development, to ensure homes are designed to be adaptable to meet current and future needs, and to achieve a higher water efficiency standard, to protect natural assets and ensure appropriate provision for residents, all in accordance with Policies I1, A2 and E7 of the Great Yarmouth Local Plan.
4.Further to the requirements of Condition 8 or outline planning permission 06/20/0498/O, there shall be no commencement of construction beyond foundation/DPC/slab level until a noise impact assessment has first been submitted to and approved in writing by the Local Planning Authority sufficient to demonstrate there will be appropriate defence and acoustic mitigation provided to future occupants of the approved dwellings in respect of the noise experienced from the close proximity of multiple garages and car workshops and the Acle New Road traffic. The details shall include noise mitigation measures to reduce noise disturbance and technical specifications thereof. The development shall thereafter be constructed in strict accordance with the details as approved, which shall be installed and made operational in each dwelling prior to the first occupation of each dwelling. The mitigation measures shall be retained and maintained as such thereafter. Reason: To determine the potential impact of surrounding activities on the proposed dwellings, in the interests of protecting future amenity in accordance with Policies A1 and A2 of the Great Yarmouth Local Plan.
5.The works shall be carried out in complete accordance with the Landscape Maintenance Plan from GDC Ltd. as received by the Local Planning Authority on 20th February 2024 and the associated landscaping drawing details shown in drawing ref no. 2820-24 received on 20th February 2024 and shall be retained as such thereafter. The planting shall be carried out as approved. If within a period of TEN YEARS from the date of planting any tree or plant or any tree or plant planted in replacement for it, is removed, uprooted or is destroyed or dies, (or becomes in the opinion of the Local Planning Authority, seriously damaged or defective) another tree of the same species and size as that originally planted shall be planted at the same place, unless the Local Planning Authority gives its written consent to any variation. Reason: In the interests of biodiversity protection and enhancement in accordance with the expectations of the NPPF.
6.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for providing GIRAMS Habitat Impacts Mitigation of £210.84 per dwelling. Following receipt of £110 per dwelling at outline stage, a further £1411.78 was paid in two instalments on 1st and 4th March 2024 to address this requirement.
7.Informative Notes - The Outline Planning Permission 06/20/0156/O contains a number of compliance Conditions that still require discharge and compliance is also required with the following conditions: · Condition 4 - Details of site and finished flood levels submitted for approval pre commencement. · Condition 5 - Details of surface water drainage strategy submitted for approval pre commencement. · Condition 9 - Phase 2 site investigation strategy carried out -contaminated land pre commencement. · Condition 14 - Details of parking, drainage roads footways etc submitted for approval pre commencement. · Conditions 17 - Details of parking for construction workers submitted for approval, pre-commencement. · Conditions 18 - Details of biodiversity enhancement strategy submitted for approval. Prior to above slab level works.
8.Advisory Notes - The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems. Disclaimer re contamination NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future. Hours of Work: Due to the close proximity of other residential dwellings and businesses, the hours of any construction or refurbishment works should be restricted to: · 0730 hours to 1830 hours Monday to Friday · 0830 hours to 1330 hours Saturdays · No work on Sundays or Bank Holidays. Local Air Quality: The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed: · An adequate supply of water shall be available for suppressing dust; · Mechanical cutting equipment with integral dust suppression should be used; · There shall be no burning of any materials on site, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence. Asbestos: The developer is reminded that prior to any refurbishment commencing on site the building/s to be refurbished are required to be surveyed for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012. Any asbestos containing materials which are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority. The uncontrolled refurbishment of buildings could result in the contamination of soils on site and in the vicinity of the demolition. This could cause the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land.
