1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority: - Existing and Proposed Plans, Site Location, Block Plan and Floor Plan - Drawing Number 21/284/01 - Received 7th March 2022 The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding any details or suggested means of refuse storage presented within the application, within two months of the date of this decision, full details of the location, capacity and access for refuse storage, and collection arrangements for the waste generated by the business, shall be submitted to and approved in writing by, the Local Planning Authority. The development hereby permitted shall thereafter be operated in strict accordance with the details as approved. The reason for the condition is :- In the interests of waste management and in the interests of maintaining appropriate levels of residential amenity.
4.There shall be no installation of any external kitchen extraction, ventilation system, flues, vents or other plant and machinery until the written specifications and details of a scheme for a suitable kitchen extractor system including measures to control noise and odour within the system have first been submitted to and approved in writing by the Local Planning Authority. The development hereby permitted and the extract/ventilation system to be installed shall thereafter be operated and maintained in strict accordance with the details as approved. The reason for the condition is :- In the interests of residential and visual amenity in line with Policy A1 of the Great Yarmouth Local Plan Part 2 (adopted December 2021) and policy CS9 of the Great Yarmouth Core Strategy (2015).
5.Notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) the development hereby permitted shall not be used for any purposes other than as a cafe or restaurant defined under Class E(b) as being "for the sale of food and drink principally to visiting members of the public where consumption of that food and drink is mostly undertaken on the premises", so excluding any other purposes within Class E of Schedule 2 to the Town and Country Planning (Use Classes) Order 1987 (as amended). The reason for the condition is :- To enable the Local Planning Authority to retain control over the use of the premises because the proposal is acceptable only due to falling within the particular range of uses allowed in the Great Yarmouth Seafront Area defined by policy GY6 of the Local Plan Part 2, despite being a main town centre use in an out-of-centre location, whereas other uses within Class E could be contrary to policy GY6 and also the requirements of policies CS7 and R1 (of the Great Yarmouth Local Plan Part 2) and the objectives of the National Planning Policy Framework.
6.The premises shall not be open for business outside of the following hours:- 08:00 to 20:00 Mondays 08:00 to 20:00 Tuesdays 08:00 to 20:00 Wednesdays 08:00 to 20:00 Thursdays 08:00 to 20:00 Fridays 08:00 to 20:00 Saturdays 08:00 to 20:00 on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings in line with Policy A1 of the Great Yarmouth Local Plan Part 2 (adopted December 2021).
