No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plan received by the Local Planning Authority on the 14th January 2022: Location Plan: (unnumbered) and the development shall be carried out in accordance with the following revised plan received by the Local Planning Authority on the 22nd March 2022: Existing and proposed elevations: GDK-GYAR-82.E.01 C The reason for the condition is:- For the avoidance of doubt.
3.There shall be no installation of any plant and machinery, extraction or ventilation gear, flues or fume machinery at the premises until express written planing permission for such apparatus has first been granted by the Local Planning Authority. The reason for the condition is: - In the interests of protecting residential amenity for the occupants of flats within the the upper floors of the site and neighbouring premises, and to protect the character and appearance of the surrounding area including the conservation area.
4.A minimum vertical clearance of 3.1 metres shall be maintained at all times between the proposed structure (the projecting sign) and the level of the adjacent public highway. The reason for the condition is: - In the interests of highway safety.
5.INFORMATIVE NOTE: The premises the subject of this permission are currently within planning use class E. Future uses should remain within Class E unless moving to another class within allowances of permitted development under the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended, or following the grant of express planning permission. The applicant and future site owners and premises operators are advised that: - restaurant uses currently fall within Class E for uses which are for the sale of food and drink principally to visiting members of the public where consumption of that food and drink is mostly undertaken on the premises; and, - takeaway uses are currently not included within a use class as they are sui generis uses, whereby use as a hot food takeaway for the sale of hot food where consumption of that food is mostly undertaken off the premises, will require planning permission; and, - a mixed use of restaurant and hot food takeaway use is also likely to be considered a sui generis use and would also require planning permission.
6.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of CS09 and CS10 from the adopted Core Strategy and A1 and E5 from the Local Plan Part 2.
