1.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in the provisions of the adopted Great Yarmouth Borough-Wide Local Plan.
2.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
3.The development shall be carried out in accordance with the following revised plan no. P02 Rev E received by the Local Planning Authority on 20th October 2022. The reason for the condition is:- For the avoidance of doubt.
4.The details of the green sedum roof, artificial vegetation, external materials and balcony screen and material details submitted shall be carried out in accordance with the following revised plan no. P02 Rev E received by the Local Planning Authority on 20th October 2022. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
5.No works above slab level shall commence until details of no less than 2no. bird boxes are submitted to and approved in writing by the Local Planning Authority. Prior to the first occupation of the dwellings, the development shall be carried out in accordance with these details and the bird boxes shall remain in perpetuity. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
6.No development shall take place on site until details of an Arboricultural Implications Assessment and Method Statement are provided and agreed. The existing tree on the site shall not be felled or damaged in any way without the prior consent in writing of the Local Planning Authority. The reason for the condition is:- The existing tree is subject to a Tree preservation Order (TPO) and represents an important visual amenity which the Local Planning Authority consider should be substantially maintained.
7.The approved tree protection measures as set out in BS5837:2012 throughout the works.to be installed and retained during construction. The tree will be protected by forming Construction Exclusion Zones and temporary barriers will be erected. The barriers will consist of 2m tall welded mesh panels (Heras) supported on rubber or concrete feet. The fence panels should be joined together using a minimum of two anti-tamper couplers installed so they can be removed from the inside of the fence. The movement of plant in proximity to retained trees would be avoided. Cement, oil, bitumen or any other products which spillage would be likely to be detrimental to tree growth should be stored well away from the retained tree. Lighting of fires on site would be avoided. The reason for the condition is:- The existing tree is subject to a Tree preservation Order (TPO) and represents an important visual amenity which the Local Planning Authority consider should be substantially maintained.
8.Foul drainage shall not be discharge other than to the foul sewer. Surface water drainage shall be discharged in accordance with details to be submitted to and approved by the Local Planning Authority before any work takes place on site. The reason for the condition is:- In order to effect satisfactory drainage arrangements both on and from the site and to avoid problems of pollution of nearby water courses.
9.No development shall be commenced until details of refuse storage areas and collection arrangements are submitted for approval to the Local Planning Authority. The approved details shall be implemented in full prior to occupation/use of the development hereby permitted. The reason for the conditions is:- To ensure the provision of satisfactory servicing arrangements
10.Prior to the first occupation/use of the development hereby permitted the proposed access, on-site car parking and turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan (Drawing No. P02 Rev. E) and retained thereafter available for that specific use. Reason: To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
11.No installation of any plant and machinery on the exterior of the building / in the curtilage without prior details being provided and approved by the LPA and EHO. Reason for the condition is:- To ensure that the visual appearance of the development is maintained
12.The development shall be used for holiday purposes only. The reason for the condition is :- To ensure the holiday lets are not used as permanent residential accommodation.
13.The holiday lets shall be occupied by no one person for more than a single period of more than 28 days at any one time. The reason for the condition is :- To ensure the holiday lets are not used as permanent residential accommodation.
14.There shall be no occupation of the holiday lets as a primary residence. A log book of all guests must to be kept and made available for inspection by the LPA, where the LPA gives a minimum of 5 working days notice. The reason for the condition is :- To allow the LPA, where it considers it expedient to do so to effectively monitor this restrictive condition to ensure the holiday lets are not used as permanent residential accommodation.
15.No external lighting shall be installed other than in accordance with the lighting plan as illustrated and described on the submitted plans/design and access statement and will not cause glare beyond the site boundaries. The reason for the condition is: - In the interests of highway safety.
16.NOTES - Please read the following notes carefully:- Trade Waste: The applicant is advised that businesses require a Trade Waste contract to dispose of all waste associated with commercial activities as stated in the Environmental Protection Act 1990, Section 34. A suitable storage location on the premises and collection area must be provided.
17.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £421.68 received (30/10/2023).
18.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of noise and dust during the construction; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
19.The development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority. A quotation for the works to be carried out within the Highway will be sent to you in due course. It is an offence to carry out works within the public highway, which includes a Public Right of Way, without the permission of the Highway Authority. Advice on this matter can be obtained from the County Council's Highway Development Control Group.
