No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plans drawing references: - Site Location Plan - PL-01, received by the Local Planning Authority on 16th June 2021; - Block Plan - PL-02, received 16/07/21; and, - Proposed Layout Plan - PL-03 Revision B, received by the Local Planning Authority on 20th July 2021. The reason for the condition is:- For the avoidance of doubt.
3.Notwithstanding the details indicated on the submitted drawings no screens shall be installed nor barriers erected until the details of those features have first been submitted to and approved in writing by the Local Planning Authority, such details to include detailed drawings and specifications. The reason for the condition is:- To ensure that the works are designed to an appropriate standard in the interest of highway safety, to prevent visual clutter in the interests of visual amenity, and to prevent distractions to highways' users, and to protect the environment of the local highway corridor.
4.The tables/chairs/barriers/screens shall be located within the area shown on the approved plan only (Drawing no. 7051 PL-03 Rev. B dated 20 July 2021) and shall not be located outside of that area at any time. The reason for the condition is:- In the interests of clarity and to avoid a highway obstruction.
5.No tables/chairs/barriers/screens shall be permanently affixed to the public highway. The reason for the condition is:- In the interests of highway safety and amenity.
6.The use hereby permitted shall not take place between the hours of 23:00 and 10:00 the following day. The area will be clear of all associated furniture, barriers and other equipment during these times and at all other times when the building is not in use outside of these hours, and these items will be stored within the applicants property at all times unless in use. The reason for the condition is :- In the interest of highway safety
7.No heating apparatus or any equipment of any kind shall be placed on the site without prior consent in writing of the Local Planning Authority. The reason for the condition is :- In the interests of visual amenity.
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
9.This development involves work to the public highway. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority and that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained a. Advice on this matter can be obtained from the County Council's Highways Development Management Group based at County Hall in Norwich. Please contact Stuart French on 01603 638070. Public Utility apparatus may be affected by this proposal. Please contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be re positioned at the Applicant's own expense.
