1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and the following plans and statements received by the Local Planning Authority on 21 June 2021: Site Location Plan dated 03 June 2021; Ground Floor Plan ref. 143.200 revision A; and Heritage Statement. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (or any Order revoking or re-enacting that Order) the ground floor to the premises hereby permitted shall be used as an Adult Gaming Centre only, as designated with reference to The Gambling Act 2005 and (Licensed Premises Gaming Machine Permits) (England and Wales) Regulations 2007, and open to persons over the age of 18 therefore. The reason for the condition is:- For the avoidance of doubt and to retain control where the concept of material change offers too little certainty of control, and to ensure the use provides a service for the community, which formed part of the justification for the loss of previous retail use from the defined town centre.
4.The premises shall not be open for business outside of the following hours:- 08.00 to 22.00 on any day of the year including Sundays and Bank / Public Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
5.There shall be commencement of the use as a gaming centre until details of the means by which an active shopfront type use or display can be provided to the interior of the frontage have first been submitted to and approved in writing by the Local Planning Authority. The details shall be provided in both written description and in plan and drawn form, to an identifiable scale, and shall include details of how the display will be maintained and amended / updated on a regular basis in the event that a static display is proposed. There shall be no use of the premises as a gaming centre until the details have been approved in writing by the Local Planning Authority. The agreed works shall be installed before the use commences and shall be retained thereafter for the duration of the use hereby permitted. The reason for the condition is :- To ensure the active character of the shopfront is retained in the protected shopping frontage as set out in emergent policy R1 of the Local Plan Part 2, and as set out in core strategy policy CS7 where this is a defined prime shopping area.
6.REASON FOR APPROVAL OF THE APPLICATION :-The proposal complies with policies CS7 of the adopted core strategy and policy R1 and R3 of the emergent local plan part 2.
