1.No part of the proposed structure (the fence and posts) shall overhang or encroach upon highway land and no gate shall open outwards over the highway. Because this is a retrospective application, the applicant shall within a six month period from the date of this permission, have liaised with the County Council as Highway operator and established that the fence is located on land in the applicant's ownership and informed the Local Planning Authority that this is the case. Should the fence be located on County Highway land the applicant shall provide written and drawn details showing the fence position, the legal boundaries and the proposed fence replacement line and applied to the Local Planning Authority to provide written confirmation of the acceptability of the altered fence-line by a discharge of this condition. The revised line shall be installed in accordance with any scheme discovered as necessary within a further six months following the Local Planning Authority's agreement to the aforementioned scheme. Reason: In the interests of highway safety.
2.Note: It is the Applicant's responsibility to clarify the boundary with the public highway. Private structures such as fences, or walls will not be permitted on highway land.
