1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plans, drawing references: - Location and Block Plans - Proposed Ground Floor Plan - PL-02 - Proposed Elevations - PL-03 Received by the Local Planning Authority on 12 April 2021. The reason for the condition is :- For the avoidance of doubt.
3.The premises shall not be open to visiting members of the public outside of the following hours:- 08:00 to 23:00 Mondays to Saturdays 11:00 to 23:00 on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
4.Before the commencement of use as a takeaway, the applicant shall provide a written statement of the operator intends to provide a litter prevention, management and clearance regime in the immediate vicinity of the takeaway, and shall define and agree the extent of that responsibility on a suitable written plan. The details of the litter management scheme shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the development, and the agreed scheme shall implemented and operated upon commencement of the use, and retained as such thereafter for the lifetime of the use. The reason for the condition is :- To avoid unacceptable levels of litter around the takeaway.
5.There shall be no use of the premises for the use hereby approved until appropriate details of the proposed extraction, ventilation, flues, plant and machinery equipment and apparatus have first been submitted to and approved in writing by the Local Planning Authority. The details to be provided shall include but not be exclusive to the noise output level of the flue and fans, and odour control methodology and an appropriate maintenance regime for both aspects. The installations shall be installed in accordance with the approved details prior to the first use of the development, and shall be retained and maintained thereafter in full accordance with the approved details and maintenance schedules. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
