1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans (drawing refs: 6206-02E and 6206-03D) received by the Local Planning Authority on the 11th May 2021. The reason for the condition is:- For the avoidance of doubt.
3.The care home facility hereby approved shall not be inhabited at any time by persons under the age of 18. The reason for the condition is :- The level of outside space provided would not be suitable for children.
4.The care home facility hereby approved shall not be occupied at any time by anyone other than persons with qualifying certification to demonstrate a registered learning disability or an acquired brain injury. The reason for the condition is :- In the interests of neighbouring amenity.
5.No more than six residents shall occupy the hereby approved care home at any one time. The reason for the condition is :- To ensure adequate amenity is provided for all residents and to mitigate any pressure on the highway network.
6.Prior to the commencement of the use hereby permitted the existing vehicular access shall be widened to a minimum width of 17 metres in accordance with the Norfolk County Council residential access construction specification. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is: - To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway interests of highway safety and traffic movements.
7.Prior to the first use of the development hereby permitted the proposed access and on-site car parking shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
8.Unless otherwise first agreed in writing, the parking spaces shall be identified and used as follows: Parking Space 1 will be for the pool car; Parking Spaces 2-4 will be for the staff travelling by car; and, Parking Spaces 5-6 will be for visitors and deliveries. The reason for the condition is :- To ensure acceptable parking provision is provided and to mitigate on-road parking.
9.Deliveries shall not be take place outside of the following hours:- 08:00-18:00 Mondays 08:00-18:00 Tuesdays 08:00-18:00 Wednesdays 08:00-18:00 Thursdays 08:00-18:00 Fridays 08:00-18:00 Saturdays 08:00-18:00 on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
10.Prior to the first use of the care home hereby approved, the bird box on the north western elevation (indicated on plan 6206-03D) shall be installed. The bird box shall remain thereafter in perpetuity. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
11.Prior to the first use of the care home hereby approved, the bin storage areas (as indicated on plan 6206-02E) shall be installed and shall remain thereafter for its intended use in perpetuity. The reason for the condition is :- To ensure that the character of the area is not harmed.
12.Prior to the first use of the care home hereby approved, the boundary treatments (as indicated on plan 6206-02E) shall be provided and shall remain thereafter. The reason for the condition is:- In the interests of the visual amenities of the locality.
13.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of saved policy HOU21 from the Borough-Wide Local Plan.
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
