1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans: (all prefix 225-PP-) 24, first floor plan, 25, roof plan, 26 proposed north elevation, 27 South, 28 East, 29 West, 32 and 33 sections, construction drawings 43 to 50 and new north side extension details 61 to 63 all received by the Local Planning Authority on 23 December 2020 and further revised plans 225-PP-23, ground floor showing fencing, received 18 January 2021, 225-PP-28-A east elevation received 18 January 21 and drawing 225-PP-33-A section through showing services received 19 January 2021. and plans reference 225-PP-23-A showing disabled parking facilities received 25 January 2021 and drawings reference (225-PP-) 24 revision D updated first floor plan showing slight reduction to balcony and 28 revision C updated east elevation showing narrower balcony both received 27 January 2021 The reason for the condition is :- For the avoidance of doubt.
3.Before the public assembly use commences, a flood plan (as outlined in the recommendations of the submitted flood risk assessment) shall be submitted in writing to the local planning authority and agreed by the authority and the measures put in place in accordance to that plan also before occupation and retained and updated thereafter for the duration of the use. Further structural calculations shall be submitted before the balcony construction commences to demonstrate the structural stability of the mezzanine as a place of safety during severe events in the event that evacuation has not fully occurred. The reason for the condition is :- To ensure that mitigation measures are undertaken as the property is located within an area at risk of flooding.
4.During the works, if hidden historic features or archaeology are revealed they should be retained in-situ. Works shall be halted in the relevant area of the building and the Local Planning Authority should be notified immediately. Reason: To ensure that historic features are recorded and preserved as part of the special character of the Listed Building.
5.Before construction of the following elements proceed further details of the discrete elements shall be submitted in written and drawn form to the local planning authority and subsequently agreed by them: The balcony internally and the raised platform externally. (including the structural calculations referred to in condition 3 above) Exterior lighting New external joinery for the east gable fenestration The formation of the new openings to the walls including lintels, making good, etc. The position, type and method of installation of all new services and related fixtures (including rainwater goods, communications and information technology servicing). The works shall be carried out in accordance with the approved details. The reason for the condition is :- To preserve the character of the listed historic building.
6.The materials used in making good shall match the original materials as closely as possible, where new openings are formed the bricks shall be recovered for reuse and the mortar type and mix shall match that originally used, including aggregate type, binder and pointing finish. The reason for the condition is :- To preserve the character of the listed historic building.
7.All original external and internal historic features, part of the special character of the heritage asset (including buttresses, brickwork, joinery of historic importance, etc) should be preserved and protected from any damage throughout the works. Any damaged fabric should be repaired in a like for like manner with relevant matching materials and techniques. Reason: To ensure that regard is paid to protecting the special architectural and historic interest and integrity of the building under Section 16 of the Planning (Listed Buildings and Conservation Areas) Act 1990
8.Prior to the commencement of the development and to the satisfaction of the Environmental Services Manager, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Manager. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
9.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
10.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
11.The following measures shall be employed to protect air quality: · An supply of water shall be available sufficient for suppressing dust; · Mechanical cutting equipment with integral dust suppression shall be used; · There shall be no burning of any materials on site. Reason: The site has the potential to generate a significant amount of dust during the construction process.
12.Before use a noise report and mitigation strategy to BS4142 demonstrating that noise is to within acceptable limits as defined by the World Health Organisation is sufficiently attenuated with regard to amplified music and other performance related noise sources, shall be submitted in written form to the Local Planning Authority and subsequently approved by them. The works shall be effected on site where necessary in accordance with the findings of the noise report and mitigation strategy. The reason for the condition is :- To protect residential amenity with regard to noise.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
14.NOTES - Please read the following notes carefully:-The applicant will need an environmental permit for flood risk activities if they want to do work in, under, over or within 8 metres (m) from a fluvial main river and from any flood defence structure or culvert or 16m from a tidal main river and from any flood defence structure or culvert. The Tidal River Yare is designated a 'main river'.
