1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.

3.If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the local planning authority) shall be carried out until the developer has submitted a remediation strategy to the local planning authority detailing how this unsuspected contamination shall be dealt with and obtained written approval from the local planning authority. The remediation strategy shall be implemented as approved. The Reason for Condition is : - To protect and prevent the pollution of the water environment (particularly groundwater associated with the underlying Secondary and Principal Aquifers, from potential pollutants associated with current and previous land uses) in line with National Planning Policy Framework (NPPF; paragraphs 170 and 178), EU Water Framework Directive, Anglian River Basin Management Plan and Environment Agency Groundwater Protection Position Statements (2018). National Planning Policy Framework (NPPF) paragraph 170 states that the planning system should contribute to and enhance the natural and local environment by preventing both new and existing development from contributing to or being put at unacceptable risk from, or being adversely affected by unacceptable levels of water pollution. Government policy also states that planning policies and decisions should also ensure that adequate site investigation information, prepared by a competent person, is presented (NPPF, paragraph 178).
4.No part of the proposed structure (including its foundations) shall overhang or encroach upon highway land The reason for the condition is :- In the interests of highway safety
5.Within 6 (six) weeks of the commencement of the works hereby approved a Cat 1 Design and Check Certificate in accordance with BD2/12 of the Design Manual for Roads and Bridges, has been submitted to and approved in writing by the Local Planning Authority. All construction works shall be carried out in accordance with the approved design. The reason for the condition is :- In the interest of highway safety and to ensure fundamental elements of the development are planned for, designed and approved at the earliest possible stage and therefore will not lead to expensive remedial action adversely impacting on the viability of the development.
6.For the duration of the construction period all traffic associated with the construction of the development will comply with the Construction Traffic Management Plan and use the signed diversion route only and no other local roads unless approved in writing with the Local Planning Authority. The reason for the condition is: - In the interests of maintaining highway efficiency and safety.
7.Construction work shall not take place outside the following hours:-07:30 to 18:00 Mondays 07:30 to 18:00 Tuesdays 07:30 to 18:00 Wednesdays 07:30 to 18:00 Thursdays 07:30 to 18:00 Fridays 08:00 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays.(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is : - In the interests of the residential amenities of the occupiers of nearby dwellings.
8.The tree planting landscaping shall be carried out in accordance ENV000382C-JBAB-XX-4_WP03A-DR-EN-0001-A5-C01-Tree_Works , ENV000382C-JBAB-XX-4_WP03A-DR_EN-0002-A5-C01-Tree_Works and ENV000382C-JBAB-XX-4_WP03B-DR-EN-0001-A4-C01-Tree_Works with the scheme as approved within 6 months of completion of the development or the first avaiable planning season. Any trees and shrubs so planted which dies within 3 years shall be replaced within one year by the applicants or their successors in title. The reason for the condition is: - To enhance the visual amenities of the locality and in accordance with the agreed details.
9.REASON FOR APPROVAL OF THE APPLICATION :- The proposal accords with the Policy CS13 of the Great Yarmouth Local Plan: Core Strategy 2013-2030 adopted in 2015 STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner in accordance with the National Planning Policy Framework.
10.NOTES - Please read the following notes carefully:- Inf. 4 This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Private structures such as fences, or walls will not be permitted on highway land. The highway boundary may not match the applicant's title plan.
