| 1. | Policy TR14A in the 'Suggested Changes Report' to the Great Yarmouth
Borough Wide Local Plan Deposit Version states that within secondary
holiday areas proposals for the change of use to sole residential
occupancy, self contained residential flats, residential homes or nursing
homes may be permitted if the applicant can demonstrate that :-
a) the development would not have a significant adverse effect, either
individually or cumulatively, on the character of the area.
b) the proposed use would not have an adverse effect on the occupiers of
neighbouring buildings or be prejudicial to the economic well being of
businesses in the area.
The Council is satisfied that, since 11th June 1997, when the Planning
Inspectorate dismissed an appeal against an enforcement notice relating
to the failure to comply with condition 2 of the planning permission
(ref: 06/84/1237/CU) for the change of use from hotel to 6 holiday flats
with owner's flat on the ground floor, and required the compliance period
to be extended to 1st November 1998 to allow for the finalisation of the
policies put forward in the Borough Wide Local Plan Deposit Version, the
all year round residential use of the holiday flats (which are in excess
of those approved) has resulted in detriment to the economic well being of
general disturbance arising from the lack of on-site supervision and
management. The proposal is, therefore, contary to this policy, the object
of which is to safeguard tourist accommodation and prevent inappropriate,
unneighbourly uses.
