| 1. | The site lies within an area of town containing no specific land use designation, allocation or policy provision in the Deposit Version of the Great Yarmouth Borough Wide Local Plan apart from falling within a Conservation Area and the property itself being a listed building. In such areas the Local Plan requires that existing uses should remain. This site lies within an area of mainly retail and restaurant uses and is not characterised by the concentration of night clubs and 'disco bars' which are located within the area of King Street to the north of Yarmouth Way. Whilst the proposal is for an A3 (food and drink) use, the applicant has obtained a late night public entertainment licence and will naturally seek a late night drinks licence. Given this fact the Local Planning Authority sees the proposal as being for an additional late night attraction which it views as being a potential cause of disturbance to the residents of the nearby residential areas. The change of use, if allowed , would exacerbate the problems presently experienced in terms of late night noise, disturbance and anti-social behaviour. |
