1.The application for listed building consent is refused. A condition survey of the existing windows and door to be replaced has not been submitted in support of this application. The application therefore fails to provide justification for the removal and replacement of the existing windows and doors. Nonetheless, the proposed replacement windows and doors, by virtue of their applied (surface mounted) glazing bars are of a poor quality design that would cause less than substantial harm to the significance of the listed building, making paragraphs 212, 213 and 215 of the National Planning Policy Framework (NPPF) (updated February 2025) relevant. Paragraph 215 of the NPPF indicates that "where a development proposal will lead to less than substantial harm to the significance of a designated heritage asset, this harm should be weighed against the public benefits of the proposals". Given the reasons above, it not considered that the benefits of the proposal outweigh the harm identified in relation to the proposals. The proposals thus fail to preserve or enhance the special interest of the listed building, contrary to Section 16(2) of the Planning (Listed Buildings and Conservation Areas) Act 1990. The proposed works would therefore fail to accord with the requirements of adopted policies CS10 of the Great Yarmouth Core Strategy (2015) and E5 of the Local Plan Part 2 (2021).
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
