1.By virtue of the bulky appearance and proposed siting at the gateway to Regent Road, the development would create a detrimental impact on the character and appearance of the conservation area and the long views and character of Regent Road, which is a key component of the conservation area, introducing an irregular structure and interrupting the formal design and rhythm of the street furniture and the character of the streetscene. As such the development would causing a low level of less than substantial harm to its significance and public appreciation, in terms of the National Planning Policy Framework (NPPF), and would fail to preserve or enhance the character and appearance of the Conservation Area, contrary to the duties under Section and 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990. The limited enhancements to the existing telecommunications network would not outweigh the harm caused by the siting of the communications kiosk in this location. The proposed communications kiosk is therefore refused as it fails to conform with the requirements of Policies CS10 of the Core Strategy and E5 of the Local Plan Part 2, and is contrary to the expectations of the NPPF.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
