1.By virtue of the proposed siting and the orientation of the kiosk, the development would conflict with the use of the town centre market place as a public open space used at numerous times throughout the year for civic and community events. The proposed siting and the orientation of the kiosk would be at odds to the designed space and use of the area, and interrupt the appreciation and sense of space and openness in the new design, could deter use of the bench by creating a barrier or a screen which discourages use of the bench, and would conflict with the use of the market place overall, resulting in the loss of some of the functionality as a public open space. The limited enhancements to the existing telecommunications network would not outweigh the harm caused by the siting of the communications kiosk in this location. The proposal therefore fails to comply with the requirements of policies CS15 of the Core Strategy, and policies A3 and E3 of the Local Plan Part 2.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
