1.The proposed communications kiosk would be harmful to the visual amenity of the area by virtue of its bulky design and incongruity with the character of the street scene, and would not complement the regeneration plans anticipated to come forward under adopted Core Strategy policy CS17. The proposed siting, on a shared section of pedestrian and cycle footway, adjacent to the highway would also result in detriment being caused to the safe functioning of the highway. The limited enhancements to the existing telecommunications network would not outweigh the harm caused by the siting of the communications kiosk in this location. The proposal therefore fails to comply with the requirements of policies CS9, CS16 and CS17 of the Core Strategy, and policies E5 and I2 of the Local Plan Part 2, and would be contrary to the expectations of the adopted Borough-wide Design Code Supplementary Planning Document.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
