| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is:-
Required to be imposed pursuant to Section 18 of the Planning (Listed Building and Conservation Areas) Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The consent hereby granted shall expire at the end of 5 years beginning with the date of this decision. The signage hereby permitted shall be removed and all fixings and mountings shall be removed from the listed building curtilage and railings no later than the expiry of the 5 year period of this consent.
The reason for the condition is: -
To align with the relevant Advertisement Consent for the signs (06/25/0872/A) and to ensure the signage is removed at the end of the permitted period of use, in the interests of preserving and enhancing the character and appearance of the listed building, its curtilage and setting, in accordance with the National Planning Policy Framework, the Council's duty under Section 66(1) of the Planning (Listed Building and Conservation Areas) Act 1990, and in accordance with Policy CS10 of the Great Yarmouth Core Strategy (2015) and Policy E5 of the Great Yarmouth Local Plan Part 2 (2021). |
| 3. | There shall be no installation of any of the signage hereby permitted, until the 2 No. existing Kirsty's Cakery signs and all its mountings are first removed from the site.
The reason for the condition is :-
To reduce clutter within the view of the principal elevation of the listed building and ensure the development minimises harm to the listed building and its setting in line with the National Planning Policy Framework. Additionally, this condition is to fulfil the Council's duty under Section 66(1) of the Planning (Listed Building and Conservation Areas) Act 1990, and in accordance with Policy CS10 of the Great Yarmouth Core Strategy (Adopted 2015) and Policy E5 of the Great Yarmouth Local Plan Part 2 (Adopted 2021). |
| 4. | The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on 26.02.2026:
- Proposed Signage and Elevations (Dwg no.1626/6/S1.1)
- Site Location Plan (Dwg. no. 1626/5/SP1.1)
The signs shall be mounted in position and fixed to the railings in accordance with the details shown on the approved drawings.
The reason for the condition is:-
For the avoidance of doubt of what has been approved and in the interests of proper planning, and to avoid undesirable harm being caused to the appearance and setting of the listed building. |
| 5. | There shall be no installation of any of the signage hereby permitted, until fully detailed specifications of the materials, design, and colour scheme of the signage have first been submitted to and approved in writing by the Local Planning Authority. The signage shall thereafter be installed in strict accordance with the approved details.
The reason for the condition is :-
The design intentions presented in the application are considered acceptable in principle but lack the specific details required for a listed building consent and further detail is required to ensure the development minimises harm to the listed building and its setting in line with the National Planning Policy Framework, to fulfil the Council's duty under Section 66(1) of the Planning (Listed Building and Conservation Areas) Act 1990, and in accordance with Policy CS10 of the Great Yarmouth Core Strategy (Adopted 2015) and Policy E5 of the Great Yarmouth Local Plan Part 2 (Adopted 2021). |
| 6. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
