| 1. | The application retrospectively seeks to introduce a large House in Multiple Occupation (HMO) (sui generis use) into an area that has suffered from amenity issues associated with the continued loss of tourism uses, loss of tourist accommodation and an increase in HMO presence, and the area is proposed to be specifically designated for protection and enhancement through Emerging Local Plan policies URB13 (the Back of Great Yarmouth Seafront Improvement Area) and HOU7 (Houses in Multiple Occupation).
The proposal results in the loss of either a C3 residential dwelling in an area where the Emerging Local Plan policy URB13 sets out a desire to ensure high quality self-contained residential accommodation is protected and promoted, or the loss of a guest house (C1 use) which is resisted by adopted Core Strategy policy CS8(b) because it would result in the loss of employment at the site and from jobs associated with the operations and servicing of the guest house, and loss of tourism accommodation in the town and reduced accommodation offer to tourists which reduces investment and tourist expenditure in the Borough. These are mirrored by the similar aims of Emerging Local Plan policies HOU7 and URB13 which seek to encourage specialist and short-term holiday accommodation.
The addition of a further HMO in this area would therefore have a harmful impact on the character of the area and is contrary to the explicit aims of Emerging Local Plan Policies URB13 and HOU7 which prohibit HMOs in the Back of Great Yarmouth Seafront Improvement Area and seek to sensitively manage the transition of character of the area.
Notwithstanding the retrospective nature of the proposal, Emerging Local Plan policies URB13 and HOU7 should be given substantial weight in the decision making process given the status of the plan and its likely imminent adoption, and it is noted that the importance and status to be given to these policies now is the same as when the unauthorised use commenced in November 2025. When assessed against both the adopted local development plan and the Emerging Local Plan a loss of tourist accommodation and the use of the site as a HMO in this location is not acceptable in principle.
The proposal is, therefore, contrary to adopted Great Yarmouth Local Plan Core Strategy (2015) Policy CS8(b) (in the absence of evidence to contradict the possible loss of tourism accommodation) and Emerging Local Plan Policies URB13 and HOU7 which are significant material considerations in the determination of this application. |
| 2. | The proposal has failed to address the public open space requirements of the development, whether by on-site provision or through means to secure financial contributions towards off-site provision through enhancements to existing facilities. As such, the impacts of the development and the pressures the development places on public open spaces have not been mitigated. The proposal is, therefore, contrary to adopted Great Yarmouth Local Plan Core Strategy (2015) Policies CS14 and CS15 and Local Plan Part 2 (2021) Policies GSP8 and H4, and Emerging Local Plan Policy HEC2. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
