1.The locker unit as installed fails to preserve or enhance the character and appearance of the No.9 Winterton Conservation Area, contrary to Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990. This is due to its scale, colour and the prominent siting of the facility. The public benefit of the facility does not outweigh the harm to the significance of the Conservation Area. The development is therefore contrary to Core Strategy (2015) Policy CS10, Local Plan Part 2 (2021) Policy E5 and Emerging Local Plan Policy DHE4. The locker unit as installed in terms of its siting, proximity to residential dwellings, relationship with the private garden of no. 6 Prospect Place, and its 24 hour 7 day a week use is also considered to have an unacceptable impact on the residential amenities in the locality in terms of visual movement, activity and noise associated with use of the locker unit. It is therefore contrary to Local Plan Part 2 Policy A1.
2.STATEMENT OF POSITIVE ENGAGEMENT: In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
