| 1. | The proposed boundary wall is unacceptable on design grounds because the proposed 2m height is out of character for the area. Low-level brick walls are characteristic of the immediate local area and there are no walls of this height in the vicinity along Burgh Road. The design would be an unsympathetic contrast to the surrounding street scene. At such height, the proposed wall would also create an obtrusive feature in the street scene which is detrimental to the visual amenity of the locality and the character of the area. It is therefore considered to be contrary to Core Strategy (2015) policy CS9, Local Plan Part 2 (2021) policy H9, the adopted Design Code Supplementary Planning Document (2025) sections CI1 and BD9, and the Emerging Local Plan Policy HOU11. |
| 2. | The proposed boundary wall is unacceptable on amenity grounds because it would be an overbearing structure. It is proposed to be 2m in height with approximately 1.7m of this constructed of brick, meaning the wall would not appear visually penetrable. Its significant length at approximately 58m combined with this height mean the structure is considered to be overbearing especially in its prominent location along Burgh Road. It is therefore considered to be contrary to adopted Local Plan Part 2 (2021) policy A1. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
