1.This permission expires on 24/03/2028 and unless on or before this date an application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority, the cabins shall be removed from the site. The site is to be returned to its original use upon the expiry of this permission, and shall be cleared and returned to its previous condition no later that the expiration of 28 days following the expiry of this permission. The reason for the condition is:- The proposed cabins are to be installed on site in support of works being carried out to restore the neighbouring gasholder. The cabins are therefore permitted for the time required to complete the restoration works only. Failure to remove the cabins would result in long term harm being caused to the setting of the listed gas holders. Their removal once the restoration works are complete will allow for the site to be available for, or return to, uses which support the longer-term functioning of the employment and port areas, or for the future redevelopment of the site for residential uses as per the site allocation within the Emerging Local Plan. The condition is required for the development to accord with Policies CS6 and CS10 of the Core Strategy and policies GY10 and E5 of the Local Plan Part 2 and Policy URB9 of the Emerging Local Plan.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the dates listed below: - Figure 1 - Site Location Plan: received 14/01/2026 - Figure 2 - Block Plan: received 14/01/2026 - Figure 3 - Proposed Works Plan: received 14/01/2026 - Proposed Plans and Elevations: Ref: R12964: received 14/01/2026 - Flood Mitigation Statement and Evacuation Plan: Ref: R13163: received 12/03/2026 The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
3.There shall be no use of the development hereby permitted until all staff and operatives have first been made aware of the requirements to comply with the measures set out in the submitted and approved Flood Mitigation Statement and Evacuation Plan, and have first received training to implement the Flood Evacuation Plan. The flood mitigation measures and the Evacuation Plan shall thereafter be maintained and retained in accordance with those submitted details for the duration of the development. The reason for the condition is:- In the interests of the safety of the public and site operatives in the event of extreme weather and/or flooding, in accordance with policy CS13 of the Core Strategy (2015) and policy E1 of the Local Plan Part 2 (2021).
4.Only potable water from portable water supplies shall be used on site to mitigate the risks caused by unknown ground contamination to the temporary workers using the site. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land are minimised in accordance with section 179 of the NPPF and policy E6 of the Local Plan Part 2 (2021).
5.If, during development, contamination not previously identified is found to be present, then no further development shall be carried out in pursuance of this permission until a scheme has been submitted to and approved by the Council as Local Planning Authority detailing how this contamination shall be dealt with in accordance with the remediation scheme as set out above. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue. The reason for the condition is:- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with Policy E6 of the Local Plan Part 2 and section 179 of the NPPF.
6.The hours of works being carried out connected to the installation of the cabins shall be restricted to: 0730 hours to 1830 hours Monday to Friday 0830 hours to 1330 hours Saturdays No work on Sundays or Public or Bank Holidays. These restrictions apply to any works which are audible outside of the boundary of the site, to reduce the likelihood of noise disturbance being caused by the development approved by this permission. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings, due to the close proximity of other residential dwellings and/or businesses, in accordance with Policy A1 of the Local Plan Part 2.
7.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
