| 1. | The proposed replacement white UVPC framed windows would not match the detail or design of the historic existing timber framed windows in terms of sections, proportions or appearance and this would cause a low level of less than substantial harm to the significance of the Conservation Area and setting of the nearby listed building (Grade II Listed Gorleston Pavilion) due to the removal of a traditional material and replacement with one that is inappropriate for the surrounding historic environment. This harm is not outweighed by public benefits. The proposal is therefore contrary to Core Strategy (2015) Policies CS9 and CS10, Local Plan Part 2 (2021) Policy E5, Section CI1 of the Great Yarmouth Design Code (2024), Emerging Local Plan Policies DHE1 and DHE2, Chapter 16 of the NPPF and Sections 66 and 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
