1.In order for such a proposal to be granted Prior Approval, it is necessary for the developer to apply to the Local Planning Authority for a determination as to whether the prior approval of the authority will be required in relation to set criteria, including whether the flood risk is acceptable. The site is located within Flood Zone 3 and the application proposes additional habitable accommodation at ground floor level, increasing the vulnerability of this section of the building from a 'Less Vulnerable Use' to a 'More Vulnerable Use'. The Flood Risk Assessment submitted does not comply with the requirements for site-specific Flood Risk Assessments, as set out in Flood Risk and Coastal Change Planning Practice Guidance, and therefore it is considered that insufficient information has been provided to demonstrate that the Flood Risk arising from the proposal would be acceptable. Therefore Prior Approval is required and the application is hereby refused as the proposal fails to comply with MA.2(c) of Part 3, Schedule 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
