1.The development shall be carried out and retained in accordance with the following plans and documents submitted and approved as part planning permission 06/23/0496/HH: - Drawing no. P.14 Rev C - Proposed West Section Elevation - Drawing no. P.13 Rev E - Proposed North and West Elevations - Drawing no. P.12 Rev E - Proposed South and East Elevations - Drawing no. P.11 Rev D - Proposed Roof Plan - Drawing no. P.10 Rev C - Proposed Second Floor Plan - Drawing no. P.09 Rev C - Proposed First Floor Plan - Drawing no. P.08 Rev C - Proposed Ground Floor Plan - Drawing no. P.07 Rev D - Proposed Site Block Plan - Drawing no. P.00 Rev A - Site Location Plan - Arboricultural Impact Assessment - Ref OAS 23-160-AR01 dated July 2023 and Drawing Numbers: OAS 23-160-TS01 - Tree Constraints Plan; OAS 23-160-TS02 - Tree Layout Plan; and OAS 23-160-TS03 - Tree Protection Plan - Preliminary Ecological Appraisal & Bat Roost Assessment dated 19.09.2023 And those referred to in condition number 2 below. The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
2.The development shall be carried out in accordance with the Biodiversity Enhancement Strategy and Construction Environmental Management Plan (CEMP: Biodiversity) prepared by Eco-Check Consultancy Ltd dated 01/07/2025 Rev A., as amended by the following plans: - Page 11, Figure 3 of BES and CEMP: Biodiversity revised by Proposed Bat Loft Drawing No. P.17 Rev B - Page 12 of BES and CEMP: Biodiversity revised by Proposed Site Block Plan Drawing No.P.15 Rev A and the following drawings: - Site Location Plan Drawing No. SK12 Rev A - Bat Loft Site Plan Drawing No. P.16 Rev B The reason for the condition is :- In the interests of protected species as there is bat presence confirmed within the development and in order to mitigate any adverse impacts on ecological interests in accordance with policy CS11 of the adopted local plan, Policy NAT1 of the Emerging Local Plan and Policy 6 of the Neighbourhood Plan.
3.The development shall be carried out in accordance with the external materials submitted to and approved by the Local Planning Authority under Condition Discharge application ref: 06/24/0252/CD The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted, in accordance with policies CS9 and H9 of the adopted local plan, Policy DHE1 of the Emerging Local Plan and Policy 5 of The Neighbourhood Plan.
4.No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and approved in writing by the Local Planning Authority, and such lighting shall be designed around a strategy for light-sensitive biodiversity. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented in accordance with the details as approved and shall be retained as such thereafter. The reason for the condition is :- In the interests of dark skies and protected species as there is bat presence confirmed within the development and in order to mitigate any adverse impacts on ecological interests in accordance with policies CS11 and E6 of the adopted local plan, Policies NAT1 and NAT9 of The Emerging Local Plan and Policy 6 and Policy 9 of the Neighbourhood Plan
5.Tree Protection - Extensions to dwelling and construction of new swimming pool, gym and home leisure building: All tree protection measures as contained in: sections 3 and 4 of the Arboricultural Impact Assessment - Ref OAS 23-160-AR01 dated July 2023 and Drawing Number OAS 23-160-TS03 - Tree Protection Plan, are, in relation to protective fencing, to be installed prior to the commencement of development work (including demolition) to implement this planning permission and other tree protection measures including root pruning and driveway installation to be carried out as approved. The approved tree protection measures are to be maintained in good condition and adhered to throughout the construction period. Unless otherwise first agreed in writing by the Local Planning Authority, no construction-related activities (for example: storage and/or siting of: vehicles, fuel, materials, site huts or other buildings or ancillary equipment; raising of lowering of ground levels; installation of underground services, drains; lighting of fires etc.) may be undertaken within the identified Construction Exclusion Zones and fenced areas. In the event that any tree(s) become damaged during construction, the Local Planning Authority shall be notified, and remedial action agreed and implemented. In the event that any tree(s) dies or is removed without the prior approval of the Local Planning Authority, it shall be replaced within the first available planting season, in accordance with details to be agreed with the Local Planning Authority. The reason for the condition is :- To ensure existing trees are protected during site works in the interests of the visual amenity of the area and ecological interests and the satisfactory appearance of the development in accordance with policies CS11 and E4 of the adopted local plan and Policy NAT10 of The Emerging Local Plan.
6.Tree protection - bat loft: Tree protective fencing and ground protection as guided by the recommendations set out in BS5837 (Trees in Relation to Construction) shall be installed prior to commencement of construction of the bat loft and shall remain in place during its construction. The reason for the condition is :- To ensure existing trees are protected during site works in the interests of the visual amenity of the area and ecological interests and the satisfactory appearance of the development in accordance with policies CS11 and E4 of the adopted local plan and Policy NAT10 of The Emerging Local Plan.
7.Bat Mitigation on site: On 12 June 2024 Natural England issued a Licence - Mitigation ref 2024-68398-EPS-MIT valid from 12/06/2024 to 30/04/2036 relating to Bat Mitigation at the site related to the development permitted by 06/23/0496/HH, as referred to in Condition Discharge application ref: 06/24/0238/CD. The development must adhere to the specific details given in the licence.
