| 1. | Section SM5 of the Design Code is clear that a car-dominated environment should be avoided and development proposals should justify the level of car parking proposed. The erection of the garages and the provision of a further parking space within the rear garden of no.87 Church Road would provide a continuous line of five garages along adjacent to an off-street parking space, without justification. This creates an overly car-dominated environment, is harmful to the street scene and is detrimental to the overall residential character of the area. The proposal therefore fails to maintain or enhance the character and appearance of the dwelling and surrounding area and is therefore is contrary to Core Strategy (2015) Policy CS9, Local Plan Part 2 (2021) Policy H9, Section SM5 of the Great Yarmouth Design Code and Paragraphs 135 and 139 of the National Planning Policy Framework (December 2024). |
| 2. | The erection of the garages and the provision of a further parking space within the rear garden of no.87 Church Road reduces the rear garden of the subject property to 31sqm. This not only creates a cramped and oppressive living environment with insufficient outdoor amenity space which is detrimental to living conditions of the occupiers of no.87 Church Road, but the overdevelopment of the plot is out of keeping with the surrounding pattern of development and built form. The proposal is therefore contrary to Core Strategy (2015) Policy CS9, Local Plan Part 2 (2021) Policies H9 and A1, Section BD6 of the Great Yarmouth Design Code and Paragraphs 135 and 139 of the National Planning Policy Framework (December 2024). |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
