1.The work must first be carried out within two years of the date of this consent notice, including the replacement tree planting. The reason for the condition is: - The time limit condition is imposed as in accordance with of the Town and Country Planning Act 1990 as amended by the Town and Country Planning (Tree Preservation) (England) Regulations 2012; and allows an extended time limit to include regularly repeated operations to ensure good tree management as in accordance with the Planning Practice Guidance.
2.Replacement tree planting must be undertaken in either or both of the locations shown on the submitted plan ref: "Proposed Replacement Trees Ref HH02", received by the Local Planning Authority on the 20th June 2025. The felled trees shall be replaced between October 2025 and April 2027 and only within a planting season unless otherwise first agreed in writing with the Local Planning Authority. The replacement planting shall be in strict accordance with the Planting Schedule and Notes attached to this decision notice. For the avoidance of doubt the replacement trees shall comprise: - Fagus sylvatica x 2 or Fagus sylvatica 'purpurea' x 2 - Size: container grown minimum 45 Litre, measuring a minimum of 2.0m tall up main stem from ground level and with a stem diameter of 7.5cm or greater measured over the bark of the tree at 1.5m above the root flare (where tree's stem meets roots). - Tree to be planted and maintained thereafter in accordance with British Standard BS8545 Trees: from nursery to independence in the landscape - Recommendations, Chapters 8 and 9 The reason for the condition is:- To ensure an acceptable standard of planting and maintenance, thereby maximising the successful establishment of the replacement trees.
3.INFORMATIVE: Protected Species: The applicant should note that under the terms of the Wildlife and Countryside Act 1981, it is an offence to disturb nesting birds, bats their roosts and other protected species. You should note that work hereby granted consent does not override the statutory protection afforded to these species and you are advised to seek expert advice if you suspect that nesting birds, bats and other species will be disturbed. It should be noted that advice received from Norfolk County Council's Natural Environment Team states that an investigation should be undertaken by a licenced bat ecologist prior to undertaking any works.
4.INFORMATIVE: Property Rights: The applicant should note that this consent does not affect any private property rights and therefore does not authorise the carrying out of any work on land or entering land outside his/her control. If such works are required, it will be necessary for the applicant to obtain the landowners consent before the work starts.
5.INFORMATIVE: This proposal involves works that could affect the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
