2. | [U]PRE-COMMENCEMENT CONDITIONS[.]
No development shall take place until such a time that a detailed surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological context of the development, has first been submitted to and approved in writing by the local planning authority. The drainage strategy should demonstrate that surface water run-off generated up to and including the 1 in 100 years critical storm will not exceed the runoff-from the existing site in the equivalent return period rainfall event. The scheme shall subsequently be implemented in accordance with the approved details before the development is first occupied.
The scheme shall also include:
a) Run-off from the development site shall be restricted to the equivalent existing greenfield run-off rates for a range of events;
b) Plans and drawings shall be submitted showing the locations and dimensions of all aspects of the proposed surface water management schemes;
c) Calculations shall be submitted to demonstrate that the proposed surface water management scheme has been adequately sized to accommodate the critical duration 1 in 100 year rainfall event (incorporating the recommended allowances for the potential impacts of climate change);
d) Calculations for infiltration devices shall be based upon infiltration rates derived using infiltration testing in accordance with BRE365;and
e) Details of how the scheme shall be maintained and managed after completion.
The reason for the condition is:- To prevent the increased risk of flooding, to improve and protect water quality, improve habitat and amenity, and ensure future maintenance of the surface water drainage system; in accordance with Core Strategy (2015) Policy CS13 and Local Plan Part 2 (2021) Policy I3. |
3. | No development shall take place until such a time that a foul water strategy, which shall include provision for a discharge in to the foul sewage system has first been submitted to and approved in writing by the Local Planning Authority . The building shall not be occupied until the works time that the works have first taken place in accordance with the approved foul water strategy unless otherwise approved in writing by the Local Planning Authority.
The reason for the condition is:- To prevent environmental problems and amenity arising from flooding; in accordance with Core Strategy (2015) Policy CS13 and Local Plan Part 2 (2021) Policy I3. |
4. | No development shall take place until such a time that a scheme detailing provision for on-site parking for construction workers for the duration of the construction period has first been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented and complied with throughout the construction period.
The reason for the condition is: - To ensure adequate off-street parking during construction in the interests of highway safety; in accordance with Core Strategy (2015) Policy CS16. |
5. | No development shall take place until such a time that the following matters have first been submitted and approved in writing by the Local Planning Authority:
- evidence that an appropriate Protected Species Licence has first been issued by Natural England pursuant to regulation 55(1) Conservation of Species and Habitats Regulations 2017 (as amended) authorising the specified activity/development to go ahead; and,
- evidence of the approved Badger habitat mitigation specification required by the license having been installed and made available for use.
The development shall thereafter proceed in accordance with those details and the mitigation / compensation measures shall be retained in perpetuity in strict accordance with the details thereby approved.
The reason for the condition is :- In the interests of protected species on the site; in accordance with Core Strategy (2015) Policy CS11. |
6. | No development shall take place until such a time that a Construction Environmental Management Plan (CEMP: Biodiversity) has been submitted to and approved in writing by the local planning authority. The CEMP shall include the following:
a) Risk assessment of potentially damaging construction activities;
b) Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction;
c) Precautionary Working Method Statement (PWMS) (for GCN and Lizards) including fingertip search, and stratified vegetation removal to allow for dispersal;
d) The location and timing of sensitive works to avoid harm to biodiversity features;
- Avoidance of nesting bird season (1st March and 31st August inclusive) for the removal of vegetation.
- Badger impact zones
e) The times during construction when specialist ecologists need to be present on site to oversee works;
f) Responsible persons and lines of communication;
g) The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person;
h) Use of protective fences, exclusion barriers and warning signs.
- This in regards to protection of trees along the west of the site that have the potential for roosting bats.
The approved CEMP: Biodiversity shall be adhered to and implemented through the construction phases strictly in accordance with the approved details, unless agreed in writing by the local planning authority.
The reason for the condition is :- In the interests of protected species on the site during construction works; in accordance with Core Strategy (2015) Policy CS11. |
7. | No development shall take place until such time that a biodiversity method statement for Bats, Birds, Amphibians and Reptiles has first been submitted to and approved in writing by the Local Planning Authority. The content of the method statement shall include:
- Purpose and objectives for the proposed works,
- Detailed designs and/or working methods necessary to achieve the stated objectives
- Extent and location of proposed works shown on appropriate scale maps and plans,
- Timetable for implementation, demonstrating that works are aligned to the proposed phasing of construction,
- Persons responsible for implementation of the works,
- Initial aftercare and long-term maintenance (where relevant);
The works shall be carried out strictly in accordance with the approved details and shall be retained in that manner thereafter.
The reason for the condition is :- In the interests of protected species on the site; in accordance with Core Strategy (2015) Policy CS11. |
8. | No removal, in full or in part, of hedgerows, trees or shrubs that may be used by breeding birds shall take place between 1st March and 31st August inclusive, unless a competent ecologist has undertaken a careful, detailed check of vegetation for active birds' nests immediately before the vegetation is cleared and provided written confirmation that no birds will be harmed and/or that there are appropriate measures in place to protect nesting bird interest on site. Any such written confirmation should be submitted to the local planning authority.
The reason for the condition is :- In the interests of protected species on the site; in accordance with Core Strategy (2015) Policy CS11. |
9. | [U] NO WORKS ABOVE SLAB LEVEL CONDITIONS[.]
No works above slab level shall take place until such time that details of the materials used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. This condition shall apply notwithstanding any indication as to these matters that have been given in the current application. The materials to be used in the development shall be in accordance with the approved details.
The reason for the condition is :- In the interests of the visual amenities of the area and to enable the Local Planning Authority to control the colour, tone, texture and appearance of the materials used; in accordance with Core Strategy (2015) Policy CS9. |
10. | No works above slab level shall take place until such time that a biodiversity enhancement plan has first been submitted to and approved in writing by the Local Planning Authority, detailing the enhancement measures for biodiversity on site. The measures shall be carried out strictly in accordance with the approved scheme prior to the first use of the development and retained in the approved form for the lifetime of the development.
The reason for the condition is :- To provide biodiversity enhancements on site; in accordance with Core Strategy (2015) Policy CS11. |
11. | No works above slab level shall take place until such time that details in written and drawn form of the means by which electric vehicle charging shall be made available for common parking areas within the scheme have first been submitted to and approved by the local planning authority. The charging points shall be installed prior to first use of the building hereby approved and shall be retained in their approved form thereafter
The reason for the condition is: - To allow provision for the demand for electric vehicle charging within the lifetime of the development; in accordance with Local Plan Part 2 (2021) Policy I1. |
12. | For the duration of the construction period all traffic associated with the construction of the development permitted will use the Approved Wheel Cleaning facilities of which details were discharged as part of condition discharge application 06/15/0496/CD.
The reason for the condition is:- To prevent extraneous material being deposited on the highway; in accordance with Core Strategy (2015) Policy CS16. |
13. | [U] PRIOR TO FIRST USE CONDITIONS[.]
Prior to the commencement of the use hereby permitted a visibility splay measuring 2.4 X 41 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained free from any obstruction exceeding 1.05 metres above the level of the adjacent highway carriageway.
The reason for the condition is:- In the interests of highway safety; in accordance with Core Strategy (2015) Policy CS16. |
14. | No use of the development hereby permitted shall take place until such time that the proposed access/on-site car and cycle parking/servicing/turning/waiting areas have first been laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan (GUA-XX-XX-DR-L-016-P02) and retained thereafter available for that specific use.
The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety. |
15. | A fire hydrant served by the mains supply (min 150mm main) shall be provided prior to any of the development being occupied and to the satisfaction of the Local Planning Authority in consultation with Norfolk Fire Service. The developer will incur the full cost of the hydrant and its installation by the Water company.
The reason for the condition is:- In the interest of public safety. |
16. | No use of the hospice hereby approved shall take place until such time that the approved boundary treatments (as shown on plan 2415-GUA-XX-XX-DR-L-001-P02) have been installed in their entirety. The boundary treatments shall be retained thereafter in the approved form for the lifetime of the development.
The reason for the condition is :- To ensure adequate enclosure of the site and in the interests of visual amenity; in accordance with Core Strategy (2015) Policy CS9. |
17. | [U] ONGOING / POST OCCUPATION COMPLIANCE CONDITIONS [.]
The approved planting scheme (2415-GUA-XX-XX-DR-L-005-P02, 2415-GUA-XX-XX-DR-L-004-P02 ) shall be carried out in its entirety within the first planting and growing season following the first use of the hospice hereby permitted. For the duration of a period of 10 years from the first use of the hospice, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof.
The reason for the condition is :- To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity; in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E4. |
18. | The existing trees on the site shall not be felled or damaged in any way without the prior consent in writing of the Local Planning Authority.
The reason for the condition is:- The existing trees represent an important visual amenity ecological resource which the Local Planning Authority consider should be substantially maintained; in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E4. |
19. | No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and agreed in writing with the local planning authority. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented accordance with the approved details and shall be retained as such thereafter.
The reason for the condition is :- To mitigate the impact of uncontrolled external lighting on protected species and dark skies, in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E6. |
20. | Within 12 months of the first use of the hospice hereby approved, the the Interim Travel Plan (Document Reference: MA/VL/P24-3232/07) shall be implemented. Within 24 months of the first use of the hospice, an approved Full Travel Plan based on the Interim Travel Plan shall be submitted to and approved in writing by the Local Planning Authority. The approved Full Travel Plan shall be implemented in accordance with the timetable and targets contained therein and shall continue to be implemented as long as any part of the development is occupied subject to approved modifications agreed by the Local Planning Authority as part of the annual review.
The reason for the condition is :- To ensure that the development offers a wide range of travel choices to reduce the impact of travel and transport on the environment; in accordance with Core Strategy (2015) Policy CS16. |
21. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |

NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application based on the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
Air Quality
The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: -
- An adequate supply of water shall be available for suppressing dust;
- Mechanical cutting equipment with integral dust suppression should be used;
- There shall be no burning of any materials on site. |
