1.The development shall be carried out in accordance with the following plans and documents: Received by the Local Planning Authority on the 28th April 2025 - - Bungalow Floor Plans and Elevations as Proposed; 1712-CAM-XX-XX-DR-A-PL03 Rev B - Garage Floor Plans and Elevations as Proposed; 1712-CAM-XX-XX-DR-A-PL04 - Site Plan as Proposed; 1712-CAM-XX-XX-DR-A-PL05 Rev A - Location Plan; 1712-CAM-XX-XX-DR-A-PL07 Received by the Local Planning Authority on the 23rd July 2025 - - Plot 02 (also relevant for plots 04, 05 & 07) Floor Plans and Elevations as Proposed; 1712-CAM-XX-XX-DR-A-PL01 Rev D - Plot 03 (also relevant for plot 06) Floor Plans and Elevations as Proposed; 1712-CAM-XX-XX-DR-A-PL02 Rev D Received by the Local Planning Authority on the 28th July 2025 - - Access Plan; ref. 712-CAM-XX-XX-DR-A-PL06 Rev E and the following document approved under the previous consent ref. 06/16/0518/O, approved on the 30th August 2018: - Arboricultural Report; prepared by Greenlight, dated 16th January 2017 The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
2.During the entire course of construction, the protective fencing shall be maintained around the individual trees to be retained and the woodland area to the south of the site in accordance with the details contained in the Arboricultural Method Statement section of the submitted Arboricultural Report dated 16th January 2017. The reason for the condition is :- To ensure that no damage occurs to the trees during the course of construction, and that trees are protected as in accordance with policy CS11 of the Core Strategy, policy E4 of Local Plan Part 2 and policy E2 of Filby Neighbourhood Plan.
3.Prior to full occupation of the site, the vehicular access shall be constructed in accordance with Access Plan drawing ref. 1712-CAM-XX-XX-DR-A-PL06 Rev E, including the permeable tarmac and shingle. For the avoidance of doubt, the access shall be upgraded to a minimum width of 4.5 metres in accordance with the Norfolk County Council residential access construction specification (TRAD 5). Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge onto the highway carriageway. The reason for the condition is :- In the interest of highway safety and traffic movement, as in accordance with Norfolk County Council standards and policy CS16 of the Core Strategy.
4.Notwithstanding the submitted details, unless otherwise agreed in writing by the Local Planning Authority, the proposed private drive shall be maintained in perpetuity at a minimum width of 4.5 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular (+ or - 10 degrees) to the highway carriageway for that said distance. The reason for the condition is :- In the interest of highway safety and traffic movement, as in accordance with Norfolk County Council standards and policy CS16 of the Core Strategy.
5.Prior to the first occupation of the dwellings hereby permitted, a visibility splay measuring 2.4 x 43 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained at all times free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety, as in accordance with Norfolk County Council standards and policy CS16 of the Core Strategy.
6.Prior to the first occupation of the dwellings hereby permitted, the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety, as in accordance with Norfolk County Council standards and policy CS16 of the Core Strategy.
7.Notwithstanding the provisions of Class A of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, (or any Order revoking, amending or re-enacting that Order) no gates, bollard, chain or other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved by the Local Planning Authority. The reason for the condition is :- In the interests of highway safety, as in accordance with Norfolk County Council standards and policy CS16 of the Core Strategy.
8.Lighting of the construction site at night shall be minimised as far as is practicable. The reason for the condition is :- In order to reduce the risk of possible disruption to nocturnal animals, and minimise light pollution, as in accordance with policy CS09 and CS11 of the Core Strategy, policy A1 of Local Plan Part 2 and policy E1 of Filby Neighbourhood Plan.
9.As far as is practicable construction materials shall be stored off the ground on pallets. The reason for the condition is :- In order to prevent the provision of shelter for animals and subsequent harm when materials are moved, in accordance with policies CS11 of the Core strategy and E1 of Filby Neighbourhood Plan.
10.Construction work and deliveries to the site shall not take place outside the following hours:- - 07:30 to 18:00 Monday to Friday - 08:30 to 13:00 Saturday - and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings, as in accordance with policy CS09 of the Core Strategy and policy A1 of Local Plan Part 2.
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of the Interim Housing Land Supply Policy and Policies CS1 and CS2 of the Great Yarmouth Local Plan: Core Strategy.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
13.NOTES - Please read the following notes carefully:- 1) This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group. Please contact Developer Services on 0344 800 8020. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. 2) Please be aware it is the applicants' responsibility to clarify the boundary with the public highway. Private structures such as fences or walls will not be permitted on highway land. The highway boundary may not match the applicants' title plan.
