1. | The proposal for the maximum height of the porch will exceed 3 meters in height, as the proposed plans indicate a height of 3.43m. It is noted that the original canopy of the house is of the same height, however the plans within the remit of this application are to erect a porch. These plans are subject to the restrictions of Schedule 2 part 1 Class D of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). Criterion D of this legislation states that the maximum height of a porch within permitted development rights is 3 meters. The proposed height of 3.43m fails to comply with the limits and as such will not constitute permitted development. Therefore a certificate cannot be granted, and the certificate of lawfulness application will be refused, and planning permission will be required for the proposed development. |
