1.It is necessary for the developer to apply to the local planning authority for a determination as to whether the prior approval of the authority will be required in relation to set criteria including arrangements required for the storage and management of domestic waste as set out in Condition G.1(d)(v) of Class G of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The application relies on the provision of a bin storage area (communal collection point) more than 100m distant from the flat (storage point at the home). This is not considered to be reasonably accessible or convenient in terms of location as it would require future occupiers of the flat to carry their domestic waste/refuse for an excessive distance. This arrangement is unacceptable and fails to meet the requirements of Policy A2(f) of the Local Plan Part 2 and BD7 of Great Yarmouth Design Code.
2.The site is located within the Orange 400m to 2.5km Indicative Habitats Impact Zone and the prior approval application proposes the net increase of 1no. dwelling. As such a shadow template Habitat Regulation Assessment is required. This has not been received nor has the required £304.17 Green Infrastructure and Recreational Avoidance Mitigation Strategy payment been made to the Local Planning Authority. The proposal is therefore contrary to the Conservation of Habitats and Species Regulations 2017 and Policy GSP5 of the Local Plan Part 2.
3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
