| 1. | The proposed garage building contravenes restrictive criterion "c" as set out within Schedule 2 Part 1 Class E of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), the effect of which is that the proposed development is excluded from the allowances of permitted development. The part of the proposal which does not meet the technical expectations of the General permitted Development Order is set out below: Criterion 'c' of Class E, Part 1 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), sets out that development is not permitted where the development would be situated on land forward of a wall forming the principal elevation of the original dwellinghouse. Given the proposed garage would be 2.5m forward of the principal elevation it would not constitute permitted development. Given this, a certificate cannot be granted and the certificate of lawfulness application is refused and planning permission would be required for the proposed building works. |
