| 1. | The development shall be carried out in accordance with the following plans and details:
- the revised plans approved within planning permission 06/20/0195/F, reference:
19-176-120;
19-176-121;
19-176-151;
and:
Landscape Masterplan D8496.001B dated 11/12/2020, received by the Local Planning Authority on the 6th February 2025;
Hard Landscape Plan drawing reference: D8496.003B dated 18/01/2021; and
Detailed Planting Plan, drawing reference: D8496.002A, dated 18/01/2021, received by the Local Planning Authority on the 18th March 2025.
The reason for the condition is :-
For the avoidance of doubt. |
| 2. | No gate, door, or ground floor window if installed shall open outwards over the highway.
The reason for the condition is :-
In the interests of highway safety. |
| 3. | (a) Prior to the commencement of the use hereby permitted the proposed on-site car and cycle parking and servicing and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plans listed at Condition 1 of this permission and the corresponding details approved within application 06/19/0442/CD as relevant relating to drainage, and as amended by Condition 4 of this permission.
(b) Prior to the commencement of the use hereby permitted a scheme is to be submitted to and approved by the Local Planning Authority in consultation with the Highway Authority for the parking areas to be marked/signed for their intended use.
The development shall be carried out in accordance with the approved scheme prior to the commencement of the use hereby permitted and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety. |
| 4. | The development must be carried out in strict accordance with the plans and documents relating to drainage and surface water disposal as detailed below:
Eversly Care Home Drainage Strategy (Ref: 214801 Dated 22nd April 2020) and drawing number 214801-CCL-00-XX-DR-C-3D00 Rev: P02 (Private Drainage General Arrangement Dated April 2020).
The approved scheme shall thereafter be implemented prior to the first occupation/use of the development.
The reason for the condition is :-
To prevent flooding in accordance with National Planning Policy Framework requirements, by ensuring the satisfactory management of local sources of flooding surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the SuDS proposed operates as designed for the lifetime of the development. |
| 5. | The landscaping as shown on Landscape masterplan drawing reference: D8496.001B dated 11/12/2020, Hard Landscape Plan drawing reference: D8496.003B 18/01/2021, and Detailed Planting Plan, drawing reference: D8496.002A, dated 18/01/2021 shall be completed in accordance with the approved drawings prior to the end of the first planting season following the commencement of the use of the development hereby approved.
The reason for the condition is :-
To ensure the landscaping is carried out to a suitable standard within a suitable timeframe. |
| 6. | Notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) the premises shall not be permitted to be used for any purpose whatsoever other than that applied for, namely a residential care home to be operated under Use Class C2 of the Town and Country Planning (Use Classes) Order 1987 (as amended) without first gaining the express written permission of the Local Planning Authority.
The reason for the condition is :-
To enable the Local Planning Authority to retain control over the use of the premises. |
| 7. | Construction work shall not take place outside the following hours:-
07:30 to 18:00 Monday to Friday
08:00 to 13:30 Saturday
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 8. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with the NPPF. |
| 9. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the criteria set out in Policy CS3 of the adopted Great Yarmouth Core Strategy (2015) and policy H11 of the Local Plan Part 2 (2021). |
