1.Condition 13 is a pre-commencement condition which requires that a contamination assessment should be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. The application is supported by the following details: - Phase 1 Contamination Assessment, prepared by A F Howland Associates Limited, reference RCER/25.093/Phase1, dated 7th April 2025. Notwithstanding the submission of the documentation and application to discharge the condition being made after the commencement of development, the submitted information is considered acceptable and sufficient to discharge Condition 13 in full. INFORMATIVE NOTE(S): Please refer to the Local Planning Authority's (LPA) Delegated Report relating to this determination. It is important to note that: 1. The LPA considers that the development as constructed is unauthorised due to its significant and cumulative deviation from the plans approved by planning permission 06/21/0638/F. 2. This notice of discharge of Condition 13 does not constitute a determination by the Local Planning Authority as to the wider lawfulness of the implementation of planning permission 06/21/0638/F. Specifically, it is noted that Conditions 6 and 7 of planning permission 06/21/0638/F are also considered true condition precedent pre-commencement conditions, but those conditions have not been discharged prior to the commencement of the development and remain undischarged at this point in time. 3. Please be advised that the original planning permission 06/21/0638/F requires lawful commencement of the permission by 31st May 2025.
