1.Condition 6 is a pre-commencement condition which requires that a scheme to demonstrate that the development and associated foundation design will not adversely affect the stability of the flood wall is submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. The application is supported by the following details: - Tie rod and anchor location investigation comprising letter and drawings: 25 Bridge Road Runham Vauxhall Great Yarmouth, prepared by Norfolk Partnership Laboratory, reference 106577, dated 15/04/2025 - Pile Layout and Ground Tie Rods Drawing (unreferenced) - RC Ground Beam Details: Sheet 2; Drawing reference: 2109014 04 P Rev 1 Notwithstanding the submission of the documentation and application to discharge the condition being made after the commencement of development, the submitted information is considered acceptable and sufficient to discharge Condition 6 in full. INFORMATIVE NOTE: Please refer to the Local Planning Authority's (LPA) Delegated Report relating to this determination. It is important to note that: 1. The LPA considers that the development as constructed is unauthorised due to its significant and cumulative deviation from the plans approved by planning permission 06/21/0638/F. 2. This notice of discharge of Condition 6 does not constitute a determination by the Local Planning Authority as to the wider lawfulness of the implementation of planning permission 06/21/0638/F. Specifically, it is noted that Condition 7 of planning permission 06/21/0638/F is also considered a true condition precedent pre-commencement condition, but the condition has not been discharged prior to the commencement of the development and remains undischarged at this point in time. 3. Please be advised that the original planning permission 06/21/0638/F requires lawful commencement of the permission by 31st May 2025.
