1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 4th April 2025: - Proposed Elevations, Floor Plans, Site Block Plan and Location Plan, dwg. Ref. RSPCA-IWD-XX-XX-DR-A-2500 P03 - Arboricultural Impact Assessment, Tree Protection Plan, Method Statement; prepared by C J Yardley Landscape Survey & Design LLP - Preliminary Roost Assessment; prepared by Ecology Norfolk Limited - Flood Risk Assessment ref. 230059/L Chirimunjiri; prepared by Conisbee The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
3.There shall be no commencement of development whatsoever until all the tree protection measures as detailed within the Arboricultural Impact Assessment (AIA) prepared by C J Yardley Landscape Survey & Design LLP have first been installed and brought into use. The approved tree protection measures shall thereafter be maintained in good condition and shall be observed throughout the construction period and the AIA shall be strictly adhered to throughout. In the event that any tree(s) become damaged during construction, the Local Planning Authority shall be notified, and remedial action agreed and implemented in accordance with the agreed details. The reason for the condition is :- To ensure existing trees are protected during site works in the interests of the visual amenity of the area and the satisfactory appearance of the development in accordance with policies CS9 of the Core Strategy and E4 of the Local Plan Part 2.
4.No development shall commence whatsoever until the details of a Foul Water Drainage Scheme have first been submitted to and approved in writing by the Local Planning Authority. The Scheme shall identify a sustainable point of connection to the public foul network. There shall be no use or occupation of the building hereby permitted until the foul water drainage scheme has first been carried out and made available for use in complete accordance with the approved scheme. The reason for the condition is :- To protect water quality, prevent pollution and secure sustainable development in accordance with Policies E6 and I3 of the adopted Local Plan Part 2.
5.No development shall commence whatsoever until the full details of a Surface Water Drainage Scheme, have first been submitted to and agreed in writing with the Local Planning Authority, with appropriate supporting evidence to justify the proposed drainage scheme. The details should include the results from infiltration tests and investigation into connection to nearby water courses in the event that infiltration is not considered feasible. The information shall also be presented with regard to including appropriate tree protection measures and mitigation during installation of drainage features. The development shall thereafter be carried out and made operational in strict accordance with the agreed details prior to the first use of the development and shall be retained as such thereafter. NOTE - It should be noted that it is the applicants/developers/owners responsibility to ensure adequate drainage of the site so as not to adversely affect surrounding land, property or highway. The reason for the condition is :- To protect water quality, prevent pollution and secure sustainable development in accordance with Policies E6 and I3 of the adopted Local Plan Part 2.
6.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that Order) (with or without modification), the "Animal Exercise Yard" and land surrounding the proposed building and access ramp shall be retained as grassed land. The reason for the condition is :- To protect the root protection areas of the surrounding trees in accordance with policy E4 of the Local Plan Part 2 and provide suitable mitigation of surface water flooding, as in accordance with policies CS13 and E1.
7.There shall be no use of the development hereby permitted until the Ecology Enhancement Measures set out in section 5 of the Preliminary Roost Assessment prepared by Ecology Norfolk Limited, have first been provided in full accordance with the approved details, and these shall be retained as such thereafter. The reason for the condition is :- To protect and enhance the Borough's biodiversity as in accordance with policy CS11.
8.No part of the development hereby approved, including fascia boards, rainwater guttering, windows or doors shall overhang or encroach upon highway land and no gate/door/ground floor window shall open outwards over the highway. The reason for the condition is :- In the interests of highway safety, in accordance with Policy CS16 of the adopted Core Strategy.
9.If, during development, contamination not previously identified is found to be present, then no further development shall be carried out in pursuance of this permission until a scheme has been submitted to and approved by the Council as Local Planning Authority detailing how this contamination shall be dealt with in accordance with the remediation scheme as set out above. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with section 179 of the NPPF and policy E6 of the adopted Local Plan Part 2.
