1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- Required to be imposed pursuant to Section 18 of the Planning (Listed Building and Conservation Areas) Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the revised plans received by the Local Planning Authority on the 10th December 2024: - Location Plan; ref. CD-GY-N-L01 - Proposed Site Plan and Location Plan; CD-GY-N-SL01 and the following plans received on the 4th February 2025: - Proposed Elevations; ref. CD-GY-N-02 Rev D - Proposed First Floor Plan; ref. CD-GY-N-SW02 Rev H - Proposed Second Floor Plan; ref. CD-GY-N-SW03 Rev H and the following plan received on the 11th February 2025: - Proposed Basement & Ground Floor Plan; ref. CD-GY-N-SW01 Rev J The reason for the condition is :- For the avoidance of doubt of what has been approved and in the interest of proper planning.
3.No development shall take place until details of the external extract grilles are submitted to and approved in writing by the Local Planning authority. These shall be painted metal/cast iron and traditionally detailed. The development shall be carried out in accordance with the approved details and retained as such thereafter . The reason for the condition is :- To enable the local planning authority to ensure the satisfactory appearance of the development, as required by policy CS9 of the Core Strategy, and to ensure the heritage asset is preserved and enhanced as in accordance with policies CS10 and E5 of the Core Strategy and Local Plan Part 2, and Section 66 and 72 of the Listed Buildings Act 1990.
4.No development shall take place until detailed drawings of the proposed fire doors at a scale of no less than 1:20 have been submitted to and approved in writing by the local planning authority. These shall be four panelled doors of tradition style. The development shall be carried out in accordance with the approved details and retained as such thereafter. The reason for the condition is :- To enable the local planning authority to ensure the satisfactory appearance of the development, as required by policy CS9 of the Core Strategy, and to ensure the heritage asset is preserved and enhanced as in accordance with policies CS10 and E5 of the Core Strategy and Local Plan Part 2, and Section 66 and 72 of the Listed Buildings Act 1990.
5.No development of second floor flat "flat 2", as shown on Proposed First Floor Plan; ref. CD-GY-N-SW02 Rev H and Proposed Second Floor Plan; ref. CD-GY-N-SW03 Rev H, shall take place until details of the internal rear staircase at a scale of no less than 1:20 are submitted to and approved in writing by the Local Planning authority. The development shall be carried out in accordance with the approved details. The reason for the condition is :- To enable the local planning authority to ensure the satisfactory appearance of the development, as required by policy CS9 of the Core Strategy, and to ensure the heritage asset is preserved and enhanced as in accordance with policies CS10 and E5 of the Core Strategy and Local Plan Part 2, and Section 66 and 72 of the Listed Buildings Act 1990.
6.No development of the first floor flat "flat 3", as shown on Proposed First Floor Plan; ref. CD-GY-N-SW02 Rev H, shall take place until detailed drawings of the proposed guardrail to be installed behind the existing balustrade on the south elevation has been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the details as approved and retained as such thereafter . The reason for the condition is :- To enable the local planning authority to ensure the satisfactory appearance of the development, as required by policy CS9 of the Core Strategy, and to ensure the heritage asset is preserved and enhanced as in accordance with policies CS10 and E5 of the Core Strategy and Local Plan Part 2, and Section 66 and 72 of the Listed Buildings Act 1990.
7.No development of the ground floor flat "flat 4", as shown on Proposed Basement & Ground Floor Plan; ref. CD-GY-N-SW01 Rev J, shall take place until detailed drawings of the proposed windows at a scale of no less than 1:20 and profiles of a scale no less than 1:5 have been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the details as approved and retained as such thereafter. The reason for the condition is :- To enable the local planning authority to ensure the satisfactory appearance of the development, as required by policy CS9 of the Core Strategy, and to ensure the heritage asset is preserved and enhanced as in accordance with policies CS10 and E5 of the Core Strategy and Local Plan Part 2, and Section 66 and 72 of the Listed Buildings Act 1990.
8.NOTES - Please read the following notes carefully:- Hours of Work: Due to the close proximity of other residential dwellings and/or businesses, the hours of any construction or refurbishment works that are audible outside of the boundary of the site should be restricted to reduce the likelihood of noise disturbance to: 0730 hours to 1830 hours Monday to Friday 0830 hours to 1330 hours Saturdays No work on Sundays or Bank Holidays. Asbestos: The developer is reminded that prior to any refurbishment commencing on site the building/s to be refurbished are required to be surveyed for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012. Any asbestos containing materials which are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority. The uncontrolled refurbishment of buildings could result in the contamination of soils on site and in the vicinity of the demolition. This could cause the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land. For further help and advice in respect of asbestos removal the applicant/agent is advised to contact the Health and Safety Executive (HSE) (www.hse.gov.uk/asbestos).
9.NOTES - Please read the following notes carefully:- The permission hereby granted relates solely to the listed building consent for the proposed works. The development is subject to a separate application for full planning permission (06/24/0920/F) and any further works outside of these permissions may require additional permissions.
