1. | The proposal reduces the availability of holiday accommodation in the Borough and specifically in an area designated for the particular purpose of retaining, upgrading, expanding and enhancing existing visitor accommodation, and preventing the deterioration of the Seafront Area. The retention and enhancement of holiday accommodation in designated areas is essential to enabling an enhanced tourism offer, increasing economic investment and improving the appearance of the area and the Borough overall. In addition to the loss of holiday accommodation and subsequent visitor-investment in the town, the proposal would likely result in the loss of some tourist related employment. It has not been demonstrated that the use as holiday accommodation is no longer viable, nor that an alternative tourist use is unviable. The loss of holiday accommodation is therefore not acceptable and therefore the proposal is, therefore, contrary to the Great Yarmouth Local Plan Core Strategy (2015) Policy CS8 and Great Yarmouth Local Plan Part 2 (2021) Policy GY6. |
2. | The proposal seeks to introduce a large House in Multiple Occupation into an area designated and characterised by tourist related accommodation and employment. A HMO use is prohibited in this area by policies GY6 and H12 to ensure that the character of the area is not undermined and to make sure that the area remains attractive to visitors. The proposal would therefore be contrary to Great Yarmouth Local Plan Part 2 (2021) Policy GY6 and H12. |
3. | The proposal does not provide sufficient kitchen provision for a HMO of this size. This would mean that the proposal would not provide a suitable standard of accommodation due to the number of residents proposed and lack of sufficient kitchen facilities. This would represent an over intense use of the property. The proposal would therefore be contrary to Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policies A1 and H12 and National Planning Policy Framework (December 2024) in particular paragraph 135. |
4. | Due to the inward door openings restricting manoeuvrability and furniture placement within the rooms, rooms five and seven in particular would be cramped and this would lead to an oppressive living environment for those living in those rooms, especially as with an HMO occupants are more likely to spend more of their free time in their private areas. The proposal would therefore be contrary to Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1 and National Planning Policy Framework (December 2024) in particular paragraph 135. |
5. | The proposal has failed to address the public open space requirements of the development, whether by on-site provision or through means to secure financial contributions towards off-site provision. As such, the impacts of the development and the pressures the development places on public open spaces have not been mitigated. The proposal is, therefore, contrary to Great Yarmouth Local Plan Core Strategy (2015) Policies CS14 and CS15 and Policies GSP8 and H4 of the Great Yarmouth Local Plan Part 2 (2021). |
6. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
