1.The consent hereby granted shall expire at the end of 100 years from the date of this decision. The reason for the condition is: - To comply with Regulation 14 (7) (b) of the Town and Country Planning (Control of Advertisements) Regulations 2007.
2.The development shall be carried out in accordance with the following plans and documents received by the Local Planning Authority on the 15th October 2024: · Location Plan, undated · Flag Pole Location, DWG no. INTG 001/13, undated. The reason for the condition is: For the avoidance of doubt, to confirm what has been approved and in the interests of proper planning.
3.No flag shall be displayed on the site other than those which fall within the following categories: · Flags promoting or associated with public sector institutions (e.g., local authorities, NHS, police, fire services, schools); · Flags promoting cultural, charitable or civic events (e.g., arts festivals, charity campaigns, remembrance services); · Flags representing minority groups or other recognised social groups; · Flags associated with awards or recognitions (e.g., Green Flag Award, Blue Plaque sites); · Flags representing sports clubs, national or international sporting events; · Flags of other nations or international organisations (e.g., United Nations, EU, Commonwealth); and, · Commemorative flags associated with significant historic events or anniversaries. The reason for the condition is:- To ensure that the display of flags remains appropriate in the interests of visual amenity and highway safety.
4.No more than two flags shall be displayed on each flagpole at any one time, with a maximum of four flags displayed across the site (across both flagstaffs). The maximum number of flags to be displayed at any one time shall include both a flag(s) permitted under this express consent and any flags which may be displayed under Schedule 1 of the Town and Country Planning (Control of Advertisements) Regulations 2007 (as amended). At no time shall any flag be displayed which is larger than 3 metres in width and 2 metres in height. Reason: To ensure that the display of flags remains appropriate in terms of amenity and does not result in visual clutter or become over dominant in accordance with the Advert Regulations and Local Plan Part 2 Policies A1 and A3.
5.No advertisement is to be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission. Reason: To comply with the requirements of the Town and Country Planning (Control of Advertisements) Regulations 2007 in the interests of amenity and public safety.
6.No advertisement shall be sited or displayed so as to - (a) endanger persons using any highway, railway, waterway, dock, harbour or aerodrome (civil or military); (b) obscure, or hinder the ready interpretation of, any traffic sign, railway signal or aid to navigation by water or air; or (c) hinder the operation of any device used for the purpose of security or surveillance or for measuring the speed of any vehicle. Reason: To comply with the requirements of the Town and Country Planning (Control of Advertisements) Regulations 2007 in the interests of amenity and public safety.
7.Any advertisement displayed, and any site used for the display of advertisements, shall be maintained in a condition that does not impair the visual amenity of the site. Reason: To comply with the requirements of the Town and Country Planning (Control of Advertisements) Regulations 2007 in the interests of amenity and public safety.
8.The flagpoles / flagstaffs used for the purpose of displaying the advertisements hereby permitted shall be maintained in a condition that does not endanger the public. Reason: To comply with the requirements of the Town and Country Planning (Control of Advertisements) Regulations 2007 in the interests of amenity and public safety.
9.Where an advertisement is required under these Regulations to be removed, the site shall be left in a condition that does not endanger the public or impair visual amenity. Reason: To comply with the requirements of the Town and Country Planning (Control of Advertisements) Regulations 2007 in the interests of amenity and public safety.
10.NOTE- The applicant is advised that the site and flagpoles are positioned outside of the curtilage of the building which prevents the display of any 'Schedule 3 flags' as set out by the Town and Country Planning (Control of Advertisements) Regulations 2007 (as amended), and therefore express consent is required from the Local Planning Authority for the display of any flag advertisement not listed within Schedule 1 of the Regulations on either of the two flagpoles which were permitted by planning permission 06/07/0944/F.
11.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
