1.This permission expires on 26th February 2028 and unless on or before this date application has been made to extend the permission and such application is approved by the Local Planning Authority, the static caravans and associated laundry room shall be removed from the site. The reason for this condition is :- In order to retain control over the development in the interests of assessing the need for the accommodation on a longer term basis and in terms of the visual amenities of the locality in accordance with Policy CS9 of the Core Strategy and Policy H5 of the Local Plan Part 2.
2.The development shall be carried out in accordance with the following plans and documents received by the Local Planning Authority on 26th November 2024: - Location Plan; dwg. ref. AJB/11083 - Block Plan; dwg. ref. AJB/11084 - Laundry Module Elevations; dwg. ref. AJB/11089 - Site block Plan; dwg. ref. AJB/11086/R - Waste and Refuse Strategy; prepared by M Construction Services - Caravan Layout; dwg. ref. Initio 41x14 3 Bed 2022 - Caravan Front End Elevation; dwg. ref. Initio 41x14 3 Bed - Caravan End Elevation; dwg. ref. Initio 41x14 3 Bed 13.10.23 - Caravan Side Elevation; dwg. ref. Initio 41x14 3 Bed Windowside - Caravan Side Elevation; dwg. ref. Initio 41x14 3 Bed 13.10.23 The reason for the condition is :- For the avoidance of doubt of what has been approved and in the interests of proper planning .
3.The occupation of the static caravans shall be limited to persons solely working in agriculture, and specifically on Grove Farm. The reason for the condition is :- The accommodation is required to meet a specific need in an area where residential development would not normally be permitted in accordance with Local Plan Policy H5.
4.The occupation of the static caravans hereby approved shall take place only during the period from 1st March to 31st October in any year. The reason for the condition is :- The accommodation is required to meet a specific need in an area where residential development would not normally be permitted in accordance with Local Plan Policy H5.
5.The hardstanding hereby approved shall accommodate no more than 8no. static caravans, and the static caravans shall not provide more than 48no. bed spaces in total. The reason for the condition is :- For the avoidance of doubt and to ensure adequate protection of the designated habitat sites and that sufficient mitigation for recreational impacts has been accounted for, as in accordance with policy CS11 of the Core Strategy and policy GSP5 of the Local Plan Part 2, and the Conservation of Habitats and Species Regulations 2017.
6.The new hedge(s) as indicated on drawing ref. AJB/11081, dated 21st January 2025, and described in "Hedge and tree planting scheme for proposed caravan application" statement, shall be planted within the next available hedge planting season following the date of this decision notice. This shall consist of a minimum of 0.7km of species-rich native hedgerow with trees, as in accordance with the submitted Biodiversity Net Gain Calculator as hereby approved. Any of the new plants which die, are diseased, are removed or otherwise fail within the first FIVE years following planting shall be replaced with the same species and size of plant unless otherwise agreed in writing with the Local Planning Authority The reason for the condition is :- To ensure the adequate replacement hedge planting, and in the interest of the amenity of the area in accordance with Policy E4 of Local Plan Part 2.
7.PART A) Prior to first occupation of the development hereby approved, a Biodiversity Net Gain Statement and Plan shall be submitted in accordance with the calculations of the submitted Biodiversity Net Gain Metric. PART B) The development hereby permitted shall be carried out in accordance with the approved Biodiversity Gain Plan (referred to in Part A) to ensure that there is a minimum 10% net gain in biodiversity within a 30 year period as a result of the development and the Plan shall be implemented in full. No development shall commence until a Habitat Management and Monitoring Plan (HMMP) is submitted to and approved in writing by the Local Planning Authority to ensure that there is a minimum 10% net gain in biodiversity within a 30 year period as a result of the development. The Habitat Management and Monitoring Plan (HMMP) shall include 30 year objectives, management responsibilities, maintenance schedules and a methodology to ensure the submission of monitoring reports. Monitoring reports will be submitted to the Local Planning Authority and approved in writing during years 2, 5, 7, 10, 20 and 30 from commencement of development unless otherwise stated in the Habitat Management and Monitoring Plan (HMMP), demonstrating how the BNG is progressing towards achieving its objectives, evidence of arrangements and any rectifying measures needed. The reason for the condition is :- In the interests of ensuring measurable net gains to biodiversity in accordance with Core Strategy (2015) Policy CS11 and the requirements of Schedule 7A of the Town and Country Planning Act 1990 (inserted by the Environment Act 2021)
8.Notwithstanding the provisions of Article 3, Schedule 2, Part 5 Class B of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no development (as may be required in accordance with a site licence under the Caravan Sites and Control of Development Act 1960) shall be carried out without the prior approval in writing of the Local Planning Authority. The reason for the condition is :- To enable the Local Planning Authority to retain control over the development in the interests of the visual amenities of the locality.
9.Having regard to the maintenance of living conditions for the seasonal workers occupying the accommodation hereby approved, the applicant shall provide to the Local Planning Authority upon request a copy of an up to date Gangmaster and Labour Abuse Authority licence (GLAA). The reason for the condition is :- To ensure that the occupants are able to enjoy a good standard of residential amenity whilst occupying the accommodation in accordance with Policy CS9 of the Core Strategy and Policy A1 of the Great Yarmouth Local Plan Part 2.
10.The laundry room as indicated on drawings ref. Block Plan; dwg. ref. AJB/11084 and Laundry Module Elevations; dwg. ref. AJB/11089 shall be provided prior to the occupation of the caravans hereby approved, and shall be retained as such for the duration of the temporary permission. The reason for the condition is :- To ensure that the occupants are able to enjoy a good standard of residential amenity whilst occupying the accommodation in accordance with Policy CS9 of the Core Strategy and A1 of the Great Yarmouth Local Plan Part 2.
11.The foul sewage treatment plant and soakaway system to be used for domestic sewage in connection with the caravans hereby approved, shall be provided as in accordance with "013906-03 Installation Guidelines for BioDisc® Units BF, BG, NF & NG" and drawing ref. DS0498P Issue 3. It shall be sited so as not to cause pollution of any watercourse, well, borehole, spring or ground water and maintained in accordance with the manufacturers specification. The reason for the condition is:- In order to effect satisfactory foul drainage arrangements for the caravans and to avoid pollution of the water environment, as in accordance with policies CS11 of the Core Strategy and I1 of the Local Plan Part 2.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £210.84 per 6 bed-space in this case, towards the monitoring and mitigation provided through that Strategy. It is confirmed that a payment of £1769.36 was received on the 22-01-25.
