| 1. | The development must be begun not later than the 6th August 2027, being three years from the date of the grant of planning permission for 06/24/0133/HH.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in strict accordance with the following plans received by the Local Planning Authority on 5th April 2024:
- Unreferenced plan, entitled Location Plan, dated 21st February 2024
- Plan no. 2409-002, entitled Proposed Details (submitted as Proposed Elevations, Floor and Section plan), dated February 2024

| 3. | Relating to use incidental to the dwelling:
The outbuildings to which the refurbishments are hereby approved shall be used only for purposes of private domestic storage or as an outbuildings, the use of which shall be incidental to the use of the dwelling known as The Ocean Tides, The Holway, Winterton.
At no time whatsoever shall either outbuilding be used as a separate dwelling, or for holiday purposes let commercially, nor shall they be occupied as separate units of accommodation. Neither shall any commercial storage or such activities take place from the outbuildings.
The reason for the condition is:-
For the avoidance of doubt and in the interests of the residential amenities of the occupiers of adjacent properties (in accordance with policies CS09 and A1) and in the interests of highways safety and minimising traffic impacts in accordance with Local Plan Core Strategy Policy CS16, and as no appropriate assessment has been undertaken beyond the scope of that which was proposed, to ensure there is no net-additional recreational impacts on nearby internationally designated ecological sites when compared to the long-standing existing use of the site, as would be expected by Local Plan Part 2 Policy GSP5 where new overnight residential or tourist accommodation is proposed. |
| 4. | Relating to use as an annexe:
Any use of the outbuildings as annexe living accommodation shall be undertaken only as a use incidental to the use of the main dwelling known as The Ocean Tides, The Holway, Winterton, Great Yarmouth, NR29 4BS, and shall only be used by the occupiers of the main dwelling, or their dependants, and shall not be used as a separate dwelling, nor let separately for holiday purposes, and shall not be occupied as a separate and unassociated unit of accommodation at any time whatsoever.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over the development which has been permitted in light of Policy H10 of the adopted Great Yarmouth Local Plan Part 2 and which may not otherwise have been acceptable were it not for the restrictions on occupancy imposed by this condition. |
| 5. | At no time shall the outbuildings be sold, leased or occupied independently from the main dwelling known as The Ocean Tides, The Holway, Winterton, Great Yarmouth, NR29 4BS.
The reason for the condition is :-
To enable the local planning authority to retain control over the development which has been permitted to offer a specific purpose and where the occupation of the premises as a separate dwelling would result in a sub-standard layout of land. |
| 6. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
