| 1. | The Development should be retained in accordance with the following plans received on the 3rd October 2024:
- Location Plan
- Current Floor Plans and Elevations; dwg. ref. 23/344/13
And the following plan received on the 1st July 2025:
- Parking Provision Plan; dwg. Ref. 23/344/15 Rev A
The reason for the condition is:-
For the avoidance of doubt of what has been approved and in the interests of proper planning. |
| 2. | The premises shall be used as a restaurant; and for no other purpose (including any other purpose in Class E(b); of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification).
The reason for the condition is:-
To enable the local planning authority to retain control over any future changes of use of the application site in the interests of local amenities in accordance with policies CS9 of the Core Strategy and policies A1 and R7 of Local Plan Part 2. |
| 3. | The premises shall not be open to customers other than between the hours of 12pm; and 10pm; Monday to Sunday.
The reason for the condition is:-
In the interests of amenity of local residences in accordance with policies CS9 of the Core Strategy and policies A1 and R7 of Local Plan Part 2. |
| 4. | Within 3 months of the date of the permission hereby granted the proposed on-site car parking and turning areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. For the avoidance of doubt, the "display cars" to the front of the building shall be permanently removed from the site in order to provide the required number of parking spaces.
The reason for the condition is:-
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety, in accordance with policy CS16 of the Core strategy and I1 of Local Plan Part 2. |
| 5. | Within 3 months of the date of the permission hereby granted, a scheme for the parking of cycles shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development hereby approved is first occupied /brought into use and thereafter retained for this purpose.
The reason for the condition is:-
To ensure the provision of adequate cycle parking that meets the needs of occupiers of the proposed development and in the interests of encouraging the use of sustainable modes of transport in accordance with policy I1 of Local Plan Part 2. |
| 6. | Prior to installation of any extraction equipment, including any replacements of such, full details of the scheme for the kitchen extractor system shall be submitted to and approved in writing by the Local Planning Authority. The scheme submitted shall include:
- The exact location of the equipment on a plan
- Relevant noise data sheets and any measures required to control noise from the equipment
- Full details of the odour management/ filtration system of the equipment.
The scheme as approved shall be installed, used and maintained in accordance with the manufacturer's specification/instructions prior to the commencement of use of the equipment and maintained thereafter for so long as the uses continues.
The reason for the condition is:-
To control the noise or odour emitted from the site in the interests of residential amenity, in accordance with policies CS9 of the Core strategy and polices A1 and R7 of Local Plan Part 2. |
| 7. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
