| 1. | The height of the raised part of the decking being 0.54 metres above ground level creates a platform in the rear garden curtilage from which an uninterrupted level of overlooking into neighbouring rear gardens overtop the pre-existing 1.8 metre high close boarded fence on dividing boundaries does occur (of particular concern is the overlooking into the garden and rear room windows of 17 Thurne Way). This overlooking is not mitigated by the 2.8 metre high bamboo cane trellis and means that the amenity and privacy of neighbouring properties is significantly compromised and their privacy and enjoyment of their properties impinged to an unacceptable level. The application is therefore contrary to Core Strategy (2015) Policy CS9, Local Plan Part 2 Policies H9 and A1 and National Planning Policy Framework Paragraph 135 and should be refused. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
