1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority: - Proposed Site Layout Plan reference 700/1B Rev C dated 13 October 2025, received on the 27 October 2025, and, - Updated Location Plan received 01 December 2025 The reason for the condition is:- For the avoidance of doubt.
3.Within 30 days of this decision notice details of the recently installed CCTV (on a pole on the south elevation of the Village Hall shall) be submitted in writing to the Local Planning Authority. If found acceptable by the Local Planning Authority they shall thereafter be maintained and retained in perpetuity in accordance with the details approved. Informative note to applicant: The applicant is advised that the installed CCTV is currently unauthorised until the details required by this condition have been approved, as per this condition. If the submitted details are unable to be approved the developer/applicant/owner could find themselves in breach of this condition, and the CCTV units would require express planning permission. The reason for the condition is :- In the interests of the visual amenities of the area and in the interests of promoting security and safety at the site, in accordance with Core Strategy Policies CS9 and CS11 and Local Plan Part 2 Policies A1 and E4.
4.No development shall commence until details of the surface water drainage scheme for the car park extension hereby approved have first been submitted to and approved in writing by the Local Planning Authority. The drainage scheme shall thereafter be installed and made operational prior to first use of the car park extension, in accordance with the approved details, and shall be retained and maintained as such in perpetuity thereafter. The reason for the condition is :- To minimise the possibilities of flooding and pollution in accordance with Core Strategy Policy CS13 and Local Plan Part 2 Policy E6.
5.The development shall not commence until a Habitat Management and Monitoring Plan (HMMP), or similar document, has first been prepared in accordance with the approved Biodiversity Gain Plan, and has been submitted to, and approved in writing by, the Local Planning Authority. The Plan shall include as a minimum: (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the HMMP; (c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and (e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. The reason for the condition is :- To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
6.A public right of way (PROW) lies along the western boundary of the site (Fleggburgh Footpath 10). The full legal extent of this footpath must remain open and accessible for the duration of the construction and subsequent occupation/use of the site. The reason for the condition is :- In the interests of retaining the continued and uninterrupted use of a public right of way during construction and after the development has been complete, in accordance with Core Strategy Policy CS16.
7.The car park extension hereby permitted shall be constructed using mechanically rolled tarmac planings, as detailed within the submitted application. The reason for the condition is :- For the avoidance of doubt and in the interests of the visual amenities of the area, in accordance with Core Strategy Policies CS1 and CS9.
8.Prior to their installation, full details of the proposed lighting shall be submitted to and approved in writing by the Local Planning Authority. Prior to the first use of the hereby approved car park extension, the lights shall be installed in accordance with the agreed details and shall thereafter be maintained and retained in perpetuity. The reason for the condition is :- In the interests of the visual amenities of the area, to control the levels of potential light pollution, control the impact upon dark skies, minimise impacts upon biodiversity, and in the interests of promoting security and safety at the site, in accordance with Core Strategy Policies CS9 and CS11 and Local Plan Part 2 Policies A1 and E4.
9.Prior to their installation, details of the bollards shall be submitted to and approved in writing by the Local Planning Authority. Prior to the first use of the hereby approved car park extension, the bollards shall be installed in accordance with the agreed details and shall thereafter be maintained and retained in perpetuity. The reason for the condition is :- In the interests of the visual amenities of the area and to ensure the continued access and protection of the remaining playing field and sports facilities, in accordance with Core Strategy Policy CS15, Local Plan Part 2 Policy A1, and Policy 4 of the Fleggburgh Neighbourhood Plan.
10.No use of the hereby approved car park extension shall take place until: (a) the habitat creation and enhancement works set out in the details approved in Condition 5 have first been completed; and (b) a Completion Report shall be provided evidencing the completed habitat enhancements, and shall be submitted to and approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
11.Prior to the first use of the hereby approved car park extension the existing car park shall be relined and demarked (to include the disabled spaces) in accordance with the submitted Proposed Site Layout Plan reference 700/1B Rev C dated 13 October 2025. The demarcation and relining shall be retained thereafter. The reason for the condition is :- To ensure the development continues to provide the same capacity and the number of spaces as proposed, and reduce the need for on-street parking, in the interest of highway safety in accordance with Local Plan Core Strategy Policy CS16.
12.Prior to the first use of the hereby approved car park extension the proposed car park extension shall be lined and marked prior to use (clearly showing all 37 car parking spaces and the emergency access route) in accordance with the submitted Proposed Site Layout Plan reference 700/1B Rev C dated 13 October 2025. The demarcation and lining shall be retained thereafter. The reason for the condition is :- To ensure the development continues to provide the same capacity and the number of spaces as proposed and reduce the need for on-street parking, in the interest of highway safety in accordance with Local Plan Core Strategy Policy CS16.
13.Prior to the first use of the hereby approved car park extension, direct access shall be provided to the existing footpath to Fleggburgh Church of England Primary School, as shown on the submitted Proposed Site Layout Plan reference 700/1B Rev C dated 13 October 2025. The reason for the condition is :- In the interests of retaining the use of an established footpath, in accordance with Core Strategy Policy CS16.
14.The 5 Sheffield cycle stands installed to the east elevation of the Village Hall, north of the main pedestrian entrance doors, shall be retained and maintained available for public use in perpetuity. The reason for the condition is :- To ensure the provision of adequate cycle parking and in the interests of encouraging the use of sustainable modes of transport, in accordance with Core Strategy Policy CS16 and Local Plan Policy I1.
15.Monitoring reports shall be submitted to local planning authority in writing in accordance with the methodology and frequency specified in the details approved in Condition 5 of this permission. The reason for the condition is :- To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990.
16.INFORMATIVE STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
17.INFORMATIVE Your attention is drawn to the existence of a public right of way (PROW) (Fleggburgh Footpath 10) which sits along the western boundary of the site. This permission does not authorise any interference with, obstruction or diversion of the path. It is an offence to carry out any works within the PROW without the permission of the Highway Authority (Norfolk County Council).
18.INFORMATIVE The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition ("the biodiversity gain condition") that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Based on the information available this permission is considered to be one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements listed below are considered to apply. The development is therefore subject to a pre-commencement condition requiring that a Biodiversity Gain Plan is submitted to the Local Planning Authority, and agreed, prior to commencement of the hereby approved development.
