1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on 20 January 2025:
-Plan no. 2277-HP-001 revision 01, entitled Location Plan, dated 22 August 2024
-Plan no. 2277-HP-019, entitled Site Plan as Proposed, dated 15 November 2024
-Plan no. 2277-HP-012, entitled Ground Floor Plan as Proposed, dated 15 November 2024
- Plan no. 2277-HP-014 revision 01, entitled Elevations as Proposed, dated 14 November 2024
-Plan no. 2277-HP-018 revision 01, entitled Roof Plan as Proposed, dated 15 November 2024
-Plan no. 2277-HP-020 revision 01, entitled Proposed Mechanical Installation, dated 15 November 2024
- Plan no. 2277-HP-976, entitled Bin Store Plan and Elevations, dated 14 November 2024
The reason for the condition is:-
For the avoidance of doubt of what has been approved and in the interests of proper planning. |
3. | Prior to installation of any plant or machinery, including any replacements of such, full details including location, acoustic specifications, and specific measures to control noise from the equipment, shall be submitted to and approved in writing by the Local Planning Authority. The equipment shall be installed, used and maintained thereafter in full accordance with the approved details.
Reason:
In order to prevent undue nuisance to nearby occupiers. |
4. | Prior to the commencement of use of the proposed development hereby permitted a scheme for a kitchen extractor system shall be submitted to and approved in writing by the Local Planning Authority. The scheme submitted shall include:
1. The exact location of the equipment on a plan
2. relevant noise data sheets and any measures required to control noise from the equipment
3. Full details of the odour management/ filtration system of the equipment.
The scheme as approved shall be installed, used and maintained in accordance with the manufacturer's specification/instructions prior to the commencement of use of the equipment and maintained thereafter for so long as the uses continues.
Reason:
To control the noise or odour emitted from the site in the interests of residential amenity |
5. | No deliveries shall be taken at or dispatched from the site for the purposes of the development the subject of this permission outside the following hours:
0730 hours to 2230 hours on Mondays to Saturdays,
The reason for the condition is:-
To protect the amenity of neighbouring properties and land uses; in accordance with Core Strategy (2015) POlicy CS9 and Local Plan Part 2 (2021) Policy A1. |
6. | Construction work shall not take place outside the following hours:-
07:30 to 18:30 Mondays
07:30 to 18:30 Tuesdays
07:30 to 18:30 Wednesdays
07:30 to 18:30 Thursdays
07:30 to 18:30 Fridays
08:30 to 13:30 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
7. | NOTES - Please read the following notes carefully:-
The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems |
