1.Due to the proximity and height of the proposed balcony (total height including balustrade 4m, raised floor height 3m), the development creates a raised outdoor amenity space which would have direct views into the the outdoor amenity space of No. 25 St Hilda Road to the immediate West of the site, as well as overlooking into the amenity space of the caravan park units to the North and East. This would result in an unacceptable loss of amenity to the residents of the adjoining property through overlooking, the loss of privacy and through increased activity facilitated by the balcony leading to an increase in noise and disturbance to the said occupiers. Therefore, the application is contrary to Core Strategy Policy CS09 and Local Plan Part 2 Policies A1 and H9 which both seek to protect the amenity of neighbours. The development also contradicts the Great Yarmouth Design Code (adopted January 2024) policy BD5 which seeks to protect the privacy of neighbouring outdoor amenity space.
2.The scale of the rear extension, including the proposed balustrade, creates a rear development that is incongruous to the wider area in terms of design,as no other properties around have this arrangement, and character due to the total height of the development ( 4 meters ) and unevenly displaced balustrade. This is contrary to policy CS09 and Local Plan Part 2 Policy H9 as the development does not respond to or draw inspiration from the surrounding area nor maintain or enhance the appearance of the building and its immediate surroundings
3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
