| 1. | In order for such a proposal to be granted Prior Approval, it is necessary to comply with all conditions set out under MA.2.
MA.2 (f) requires that the development provide an adequate amount of natural light in all habitable rooms of the dwellinghouses. The bedroom to the northern end of the building, will only be served by 1no. narrow high level 'letterbox' window. The quality of daylight received from these windows is not considered to be acceptable as the daylight and sunlight received through the window will be severely restricted due to the small scale of the window. As a result, future occupiers would be heavily reliant on artificial lighting throughout most of the day which would create poor quality living conditions. Therefore, the development proposed does not accord with Condition 2(f) of Class MA, of Part 3, Schedule 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), and is contrary to paragraphs 135(f) and 139 of the National Planning Policy Framework (which is consistent with the expectations of policies A1 and A2 of the adopted Local Plan Part 2). |
| 2. | Furthermore, no information has been provided to demonstrate that the use of the former commercial building and curtilage would be safe for residential use and provide suitable amenity standards. Therefore, the development proposed does not provide the evidence to suggest that it will accord with Condition 2(b) of Class MA, of Part 3, Schedule 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), and is contrary to paragraphs 189(a), 190 and 191 of the National Planning Policy Framework (which is consistent with the expectations of policies E6, A1 and A2 of the adopted Local Plan Part 2). |
