No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on Site Location Plan; drawing reference: 23167-LSI-AAA-RF-DR-A-1100 Rev P05 Proposed Site Plan; drawing reference: 23167-LSI-AAA-ZZ-DR-A-1300 Rev P03 Proposed Site Layout; drawing reference:23167-LSI-AAA-00-DR-A-1303 Rev P03 Proposed GA Plan (1 of 2); drawing reference: 23167-LSI-AAA-XX-DR-A-1301 Rev P01 Proposed GA Plan (2 of 2); drawing reference: 23167-LSI-AAA-XX-DR-A-1302 Rev P03 Proposed Roof Plan; drawing reference: 23167-LSI-AAA-RF-DR-A-1310 Rev P03 Proposed Elevations; drawing reference: 23167-LSI-AAA-ZZ-DR-A-1350 Rev P03 Proposed Site Sections; drawing reference: 23167-LSI-AAA-ZZ-DR-A-1370 Rev P03 Indicative Proposed Landscaping Plan (Plan 1 of 2); drawing reference: 23167-LSI-AAA-00-DR-A-1304 Rev P03 Indicative Proposed Landscaping Plan (Plan 2 of 2); drawing reference: 23167-LSI-AAA-00-DR-A-1305 Rev P01 Drainage Strategy Plan; drawing number: C-100 P01 Construction Management Plan; reference: 15114 The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
3.If commencement has not been made within 12 months of the date of this permission then a revised Biodiversity Net Gain Statement, Plan and Matrix shall be submitted to and approved in writing by the Local Planning Authority. The development shall thereafter take place in accordance with the revised Biodiversity Net Gain Statement, Plan and Matrix. The reason for the condition is :- In the interests of ensuring measurable net gains to biodiversity in accordance with Core Strategy (2015) Policy CS11 and the requirements of Schedule 7A of the Town and Country Planning Act 1990 (inserted by the Environment Act 2021)
4.The development hereby permitted shall be carried out in accordance with the submitted Biodiversity Gain Plan prepared by Wild Frontier Ecology and dated 20th May 2024 (or an updated Biodiversity Net Gain Plan as required by condition 3 of this permission) to ensure that there is a minimum 10% net gain in biodiversity within a 30 year period as a result of the development and the Plan shall be implemented in full. No development shall commence until a Habitat Management and Monitoring Plan (HMMP) is submitted to and approved in writing by the Local Planning Authority to ensure that there is a minimum 10% net gain in biodiversity within a 30 year period as a result of the development. The Habitat Management and Monitoring Plan (HMMP) shall include 30 year objectives, management responsibilities, maintenance schedules and a methodology to ensure the submission of monitoring reports. Monitoring reports will be submitted to the Local Planning Authority and approved in writing during years 2, 5, 7, 10, 20 and 30 from commencement of development unless otherwise stated in the Habitat Management and Monitoring Plan (HMMP), demonstrating how the BNG is progressing towards achieving its objectives, evidence of arrangements and any rectifying measures needed. The reason for the condition is :- In the interests of ensuring measurable net gains to biodiversity in accordance with Core Strategy (2015) Policy CS11 and the requirements of Schedule 7A of the Town and Country Planning Act 1990 (inserted by the Environment Act 2021)
5.Notwithstanding the submitted details (as shown on Indicative Proposed Landscaping Plans drawing references: 23167-LSI-AAA-00-DR-A-1304 Rev P03 and 23167-LSI-AAA-00-DR-A-1305 Rev P01), no use of the Vacuum Insulated Evaporator hereby permitted shall take place until such time that full details of a soft landscaping and planting scheme have first been submitted to and approved in writing by the Local Planning Authority. The precise details of the landscaping proposals shall include: - full specifications of all new planting along with details for their protection during establishment. For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance unless otherwise agreed in writing with the Local Planning Authority. The reason for the condition is :- Because the precise details have not been submitted and in the interests of the satisfactory visual amenity; and to ensure such soft landscaping measures are in line with the Biodiversity Net Gain Plan; in accordance with Core Strategy (2015) Policies CS9, CS11 and Local Plan Part 2 Policy E4.
6.The approved planting scheme secured by condition 5 of this permission shall be carried out in its entirety within the first planting and growing season following the first use of the Vacuum Insulated Evaporator hereby permitted. For the duration of a period of 10 years from the first use of the Vacuum Insulated Evaporator, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof. The reason for the condition is :- To ensure a high quality of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity, in accordance with Core Strategy (2015) Policies CS9, CS11 and Local Plan Part 2 Policy E4.
7.No use of the Service Compound hereby permitted shall take place until such time that an Odour Management Plan has first been submitted to and approved in writing by the Local Planning Authority. The plan should include, but not be limited to: · How odour will be monitored and controlled so it does not reach unacceptable levels, particularly during warmer weather. · Contact arrangements by which residents can raise any concerns and, issues. · The mechanism for investigating and responding to residents' concerns and complaints. The development shall take place in accordance with the approved measures contained within the Odour Management Plan. The reason for the condition is :- To mitigate odours to nearby residential receptors, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
8.No use of the Service Compound hereby permitted shall take place until such time that noise barrier has been recommended for the northern and part of the eastern boundary of the compound has been installed in its entirety. Verification evidence that the noise barrier has been installed and is operating as intended shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the Service Compound. The reason for the condition is :- To mitigate noise disturbances to residential receptors, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
9.Skip / Refuse Collections shall not take place outside of the hours of 07:30 to 19:00 on any day. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
10.No use of the Vacuum Insulated Evaporator hereby permitted shall take place until such time that details of no fewer than 2no. bird boxes (including their type and positioning) have first been submitted to and approved in writing by the Local Planning Authority. Prior to the first use of the Vacuum Insulated Evaporator, the development shall be carried out in accordance with these details and the bird boxes shall remain in perpetuity thereafter. The reason for the condition is :- To secure biodiversity enhancements in line Core Policy (2015) CS11 and in line with the recommendations contained within the Ecology Report (Frontier Ecology).
