1.The proposed annexe, by reason of its excessive footprint, massing and internal layout, would not be ancillary or subordinate in scale to the host dwelling. Instead, it would amount to accommodation of a size and form more consistent with an independent dwelling. The proposed annexe's size is additionally substantially in excess of the requirements of a 1-bedroom annexe. As such, the development fails to comply with Policy H10, which requires annexes to remain ancillary and subordinate in nature, and conflicts with Policy H9 and Core Strategy Policy CS09 which require development to respect the scale, form and character of the host property and its surroundings.
2.The proposed annexe, by reason of its scale, height, length and siting along the northern boundary with No. 3 Baillie Close, would create an overbearing form of development that would significantly enclose and overshadow the neighbouring garden, resulting in an unacceptable loss of residential amenity. The proposal is therefore contrary to Policies H9(b), H10 and A1 of the Local Plan, which seek to protect the amenity of neighbouring occupiers from overbearing impacts and overshadowing.
3.The proposed annexe, due to its scale, layout and degree of separation from the host dwelling, would not be readily capable of practical incorporation into the principal dwelling once there is no longer a need associated with it. The proposal is therefore contrary to the requirements of Policy H10(c) of the Local Plan.
4.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
