1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the revised plan received by the Local Planning Authority on 12th June 2024:
- Site Location & Proposed Site Layout Plan - Drawing No. 7339-P01 Rev E
- Proposed Ground Floor Plan, Elevations and Sections Drawing No. 7339-P02 Rev A
and the following plans received on the 24th July 2024:
- Front Elevation Kitchen Extraction (unreferenced plan)
- Kitchen Extraction (section) (unreferenced plan)
- Rear Elevation Kitchen Extraction (unreferenced plan)
- Roof Kitchen Extraction (unreferenced plan)
- South Side Elevation Kitchen Extraction (unreferenced plan)

3. | Notwithstanding the submitted details, the development hereby permitted shall not be brought into use until full details of the air handling units, kitchen extraction system, fume manifolds, flues and plant and machinery have first been submitted to and approved in writing by the Local Planning Authority.
The details to be submitted shall include full details of the specifications of noise emissions, odour control systems and mitigation measures thereof, and suitable screening details to avoid the equipment and machinery being visible from the public realm.
The development shall thereafter be undertaken in accordance with the details as approved prior to first use, which shall be retained and maintained for the duration of the use of the premises pursuant to the permission hereby granted.
The reason for the condition is :- In the interests of protecting the amenity of nearby residential and business uses, to ensure a suitable design of development and to avoid causing a detrimental impact on the character and appearance of the conservation area, in accordance with policies CS09, CS10 of the Core Strategy and A1, R7 and E5 of Local Plan Part 2. |
4. | Prior to installation, the proposed large extract (discharge cowl and fresh air unit) which will be located above the eaves height of the premises, shall be powder coated in black and shall be retained as such thereafter.
The reason for the condition is :- In the interest of visual amenity, to ensure a suitable appearance of development and to avoid causing a detrimental impact on the character and appearance of the conservation area, in accordance with policies CS09, CS10 of the Core Strategy and A1, R7 and E5 of Local Plan Part 2. |
5. | Prior to the first use of the development hereby approved, details of a bin enclosure shall be submitted to and approved in writing by the Local Planning Authority. The bin store shall be provided prior to the first use of the development hereby permitted, and shall remain in place for that use thereafter.
The reason for the condition is :- To ensure the adequate storage of bins for the purposes of visual amenity. |

Hours of Work:
Due to the close proximity of other residential dwellings and businesses, the hours of any construction or refurbishment works should be restricted to reduce the likelihood of noise disturbance to:
0730 hours to 1830 hours Monday to Friday
0830 hours to 1330 hours Saturdays
No work on Sundays or Bank Holidays. |
7. | Trade Waste:
The applicant is advised that businesses require a Trade Waste contract to dispose of all waste associated with commercial activities as stated in the Environmental Protection Act 1990, Section 34. |
8. | Asbestos note:
The developer is reminded that prior to any refurbishment commencing on site the building/s to be refurbished are required to be surveyed for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012. Any asbestos containing materials which are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority.
The uncontrolled refurbishment of buildings could result in the contamination of soils on site and in the vicinity of the demolition. This could cause the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land.
